The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated April 27, 2007, and duly recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Deed of Trust Book 5026, at Page 7387, Jesse L. Daniels and Kimberly Ann Daniels did convey unto Mike Day and Carl W. Roop, Trustees, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Raleigh County Courthouse, in Beckley, West Virginia, on
July 2, 2025, at 12:51 PM
The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Shady Spring District, Raleigh County, West Virginia, and more particularly described as follows:
That certain lot or parcel of land, together with all improvements thereon and all appurtenances thereunto belonging, situate in the Shady Groves Farm Extension, Shady Spring District, Raleigh County, West Virginia, as shown on a map thereof recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Map Book No. 8, at Page No. 119, to which reference is hereby made for a more particular description of the lot herein conveyed. And being Lot No. 264 of said extension, being more particularly described and bounded as follows:
Lot No. 264 fronts 200 feet on Fairview Avenue, and extends back therefrom with Lot No. 263 a distance of 500 feet, and back on opposite side with Lot No. 265, a distance of 500 feet and being 200 feet on rear, and containing 2.29 acres, more or less.
And being the same property conveyed to Kimberly Ann Daniels, by Deed dated the 29th day of April, 2003, from Paul R. Thompson, Jr., and of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Deed Book 5009, at Page 6068.
At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 363 Branchland Avenue, Cool Ridge, WV 25825.
AND BEING the same real estate which was conveyed to Jesse L. Daniels and Kimberly Ann Daniels, by Deed dated September 20, 2006, from Kimberly Annn Daniels and recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Deed Book 5023, at Page 9779.
The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: Ten percent (10%) of the purchase price as a deposit with the balance due and payable within 30 days of the day of sale.
