NOTICE OF PUBLIC HEARING

This is notice that on the 8th day of July, 2025, in the Raleigh County Commission Courtroom at 116 ½ North Heber Street, Beckley, West Virginia, at 5:00 PM, the Board of Zoning Appeals of Raleigh County, West Virginia, will hold a public hearing upon the petition of Nicholas A. Pack for the purpose of a Conditional Use Permit for a minimum width & minimum setback variance on property located at 286 Hughes Road, Daniels, WV, Shady Spring District, Tax Map 21, Parcel 5.5, Raleigh County, West Virginia.

Activity:
To modify an existing permit to acknowledge the performance of the analytical results required by 40 CFR Part 122, Appendix J on Outlet 001 from the wastewater treatment plant. The data is indicative that nitrate is present in the effluent waste stream discharged from the wastewater treatment plant. Therefore, monitoring requirements for nitrate are being established at Outlet 001 which discharges treated wastewater to the Tug Fork of the Big Sandy River.

Compliance was attained in accordance with the terms and conditions of Administrative Order No. 10133, dated May 17, 2023.

On the basis of review of the application, the “Water Pollution Control Act (Chapter 22, Article 11-8(a)),” and the “West Virginia Legislative Rules,” the State of West Virginia will act on the above application.

Any interested person may submit written comments on the draft permit modification and may request a public hearing by addressing such to the Director of the Division of Water and Waste Management within 30 days of the date of the public notice. Such comments or requests should be addressed to:

The public comment period begins June 21, 2025 and ends July 21, 2025.

Comments received within this period will be considered prior to acting on the permit modification application. Correspondence should include the name, address and the telephone number of the writer and a concise statement of the nature of the issues raised. The Director shall hold a public hearing whenever a finding is made, on the basis of requests, that there is a significant degree of public interest on issues relevant to the Draft Permit Modification(s). Interested persons may contact the public information office to obtain further information.
