NOTICE OF TRUSTEE’S SALE
NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated January 21, 2000, executed by Borrower(s), Eddie W Pauley and Loretta M Curry, to Brad Sorrells, Attorney At Law, the Trustee of record in the office of the Clerk of the County Commission of Raleigh County, West Virginia, in Book 5001, at Page 5531. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 941 Pine Branch, Glen Daniel, WV 25844. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated December 22, 2020, of record in the Clerk’s Office in Book 5073, Page 0418. The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Raleigh County, in Beckley, West Virginia, on the following date:

All that certain 2.000 acre tract, and a 20-foot right of way, which are part of a 27.4 acre, more or less, tract, situated on the waters of Marsh Fork of Coal River, Marsh Fork Tax District, Raleigh County, West Virginia, and being more particularly bounded and described as follows:
BEGINNING at a concrete monument, found, on line of Michael Fain Pettry et als; thence with said Pettry the following three (3) calls: N 52deg. 06′ E 140.77 feet to a nail found and replaced with a 1/2-inch rebar; N 32deg. 48′ E 73.69 feet to a concrete monument, found; S 86deg. 45′ E 342.55 feet to a 1/2-inch rebar, set; thence leaving said Pettry and running through original tract with new lines the following two (2) calls: S 02deg. 49′ W 255.07 feet to a 1/2-inch rebar, set; N 75deg. 20′ W 496.68 feet to the Point of Beginning, and containing 2.000 acres, more or less.
The 20-foot right of way included in this conveyance, which is a part of the original 27.4 acre, more or less, tract, which right of way leads from the 2.000 tract to West Virginia County Route 3/9, is more particularly bounded and described as follows:
BEGINNING at a point on line of the above mentioned 2.000 acre tract, said point being situated S 75deg. 20′ E 154.44 feet from a concrete monument, found; thence with said tract,
S 75deg. 20′ E 22.11 feet to a point; thence leaving said tract and running with a new line through the original; S 39deg. 53′ W 133.79 feet to a point on the northern right of way line of West Virginia County Route 3/9; thence with the said right of way the following two (2) calls: N 61deg. 40′ W 12.34 feet; N 54deg. 32′ W 7.93 feet to a point; thence running with a new line through the original tract; N 39deg. 53′ E 127.45 feet to the point of beginning.
Said tract and right of way are more particularly set forth on a map attached hereto and made a part hereof, entitled “PLAT SHOWING BOUNDARY SURVEY OF A 2.000 ACRE TRACT BEING A PART OF AN +27.4 ACRE TRACT SITUATED ON THE WATERS OF MARSH FORK OF COAL RIVER MARSH FORK DISTRICT, RALEIGH COUNTY WEST VIRGINIA OWNED BY BEULAH AGNES SIZEMORE TO BE CONVEYED TO EDDIE PAULEY & LORRETTA CURRY: prepared by Eastern Surveying, Inc., dated December 06, 1999, revised January 05, 2000 and January 06, 2000.
Being the same property conveyed to Eddie W Pauley and Loretta M Curry by the Deed dated January 21, 2000 and recorded in Deed Book 5001 at Page 5532 in the Office of the Clerk of the County Commission of Raleigh County, West Virginia.
TERMS OF SALE:
1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.
2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code § 11-22-1.
3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.
4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.
5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.
6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
