NOTICE OF JUDICIAL SALE

Pursuant to Court Order entered by the Honorable Judge Irons in the Circuit Court of Summers County, West Virginia, Civil Action No. CC-45-2023-P-10, the undersigned, Laura Richmond Moye, Special Commissioner of said Court, will offer for sale at public auction on the
front steps of the Summers County Courthouse, 120 Ballengee Street, Hinton, West Virginia, on:

October 22, 2025
11:00 A.M.

The following property more particularly described as: Summers County, Jumping Branch District (05), Map 8, Parcels No 5 and 5.1

TRACT NO. 1 (Surface Only) BEGINNING on the southerly R/W line of W.Va. Secondary Route NO. 25 and a corner to Valerie Underwood; thence with said R/W and binding thereon N. 81-46 E. 100.12 feet to an I.P. corner to Violet Underwood 1.0 acre tract; thence with two lines of Violet Underwood S. 4-05 E. 348.00 feet to an I.P.; thence N. 79-04 E. 125.00 feet to an I.P. in the line of Estie and Connie Underwood; thence with Estie Underwood S. 4-05 E. 176.61 feet to a 22” W.O.; common corner to James Simmons and Valerie Underwood; thence with Valerie Underwood N. 7-18 E. 978.95 feet to the BEGINNING.

BEGINNING at an I.P. on the southerly R/W line of W.Va. Secondary Route No. 25 and a corner to Robert L. Butler, Ill, and Victoria Butler, thence with said R/W and binding thereon N. 79-04 E. 112.76 feet to an I.P. thence N. 89-09 E. 11.70 feet to a 19” maple corner to Estie and Connie Underwood; thence with Underwood S. 4-05 E. 358.00 feet to an I.P.; a corner to Robert L. Butler, III, thence with Butler S. 79-04 W. 125.00 feet to an I.P.; thence N. 4-05 W. 348.00 feet to the BEGINNING. Tract Nos. 1 and 2 are shown on a map prepared by Hamilton Sharpe Associates dated April 30, 1974m and recorded in the Office of the Clerk of the County Commission of Summers County, WV in Map Book 2, at page 41.

TERMS OF SALE:
• Highest bidder must execute an Offer of Purchase and Notice of Confirmation Hearing.
• Special Commissioner reserves the right to withdraw any property from sale
• Special Commissioner reserves the right to reject any bid and declare “No Sale”
• The sale of each parcel is subject to the approval and confirmation of the Court. If the highest bid for each parcel is approved and confirmed by the Court, the amount due will be payable by the approved and confirmed highest bidder within forty-five (45) days of said approval and confirmation by the Court.
• Parcels are offered for sale as-is, with all faults and without any warranty, either expressed or implied. The Special Commissioner does not warrant the condition or suitability of any parcel for any particular purpose.
• The Special Commissioner makes no representations as to the accuracy of acreage of the parcels listed above, information being only from land records. All information provided is not guaranteed for either its completeness or accuracy. All conveyances are in gross and not by the acre.
• Parcels will be conveyed by Deed with Special Warranty of Title. Any cost of title search and all recording costs, including transfer tax, will be at the expense of the purchaser.
