NOTICE OF TRUSTEE’S SALE

NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated January 31, 2018, executed by Borrower(s), Kristie Dawn Six, to William D. Goodwin, PLLC, the Trustee of record in the office of the Clerk of the County Commission of Raleigh County, West Virginia, in Book 5066, at Page 9521, and re-recorded 5067, Page 408. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 353 Maple Meadow Mining Road, Lester, WV 25865. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated March 10, 2021, of record in the Clerk’s Office in Book 5073, Page 4814. The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Raleigh County, in Beckley, West Virginia, on the following date:

The surface only of that certain tract or parcel of land, together with the improvements thereon and all of the rights, privileges, easements and appurtenances thereunto belonging, situate in Fairdale, Trap Hill District, Raleigh County, West Virginia, containing 2.61 acres, more or less, and referenced and more particularly bounded and described as follows, to-wit:
BEGINNING at a steel rebar (set) on the eastern right-of-way line of County Route 99/5, said rebar being N 55deg. 25` 00″ W and 621.05 feet from a roof bolt (found) at the southwest corner of the 73.00 acre RAG American Coal Company tract; thence, along the eastern right-of-way line of County Route 99/5 the following two (2) courses and distances: along a curve to the left with a radius of 2599.67 feet and a chord of N 52deg. 12` 41″ W and 130.53 feet to a point of compound curvature; thence, along a curve to the right with a radius 434.02 feet and a chord of N 48deg. 43` 35″ W for 31.00 feet to a steel rebar (set); thence, the eastern right-of-way line of County Route 99/5 and passing through the 73.00 acre tract N 82deg. 08` 56″ E for 994.72 feet to point on the western line of Lot 9 of Holly Hill Acres, passing a railroad spike (set) at 732.72 feet on the western right-of-way line of the C & 0 Railway; thence, with the western line of Lot 9 of Holly Hill Acres S 38deg. 12` 36″ E and 135.32 feet to a point on the western line of Lot 9 of Holly Hill Acres; thence, leaving the line of Holly Hill Acres and passing through the 73.00 acre tract S 82deg. 08` 56″ W for 953.49 feet to the point of beginning, passing a steel rebar (set) at 262.07 feet on the western right-of-way line of the C & 0 Railway, containing 2.61 acres, more or less. Reference is hereby made to a map marked Exhibit B, entitled “Map Showing a 2.61 Acre Portion of the RAG American Coal Company Property, Situate Trap Hill District – Raleigh County – West Virginia, prepared by Lawson Engineering & Technical Services, Scale 1″ 100`, Date August, 2000,” of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia in Deed Book 5057 at Page 5705. And being the same property acquired by Kristie Dawn Six by Deed dated January 31, 2018 from Pioneer Community Bank, recorded on January 31, 2018 at Deed of Trust Book 5066, at Page 9520 in the Office of the Clerk of the County Commission of Raleigh County, West Virginia.

TERMS OF SALE:

1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.

2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code § 11-22-1.

3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.

4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.

5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
