A proceeding on the Commission’s own motion to initiate a general investigation for the purpose of establishing a task force to make recommendations regarding rules for resolution of trench sharing disputes and abandoned facilities and transfer of facilities on utility poles.

NOTICE OF FORMATION OF TASK FORCE

On July 9, 2021, the Commission initiated a General Investigation and a process for the formation of the HB 2002 Task Force in response to changes in W. Va. Code Chapters 17 and 31G to (1) make a recommendation to the Commission as to whether rules governing the resolution of trench sharing disputes are necessary, (2) if the HB 2002 Task Force concludes that trench sharing rules are necessary, to make a joint rules recommendation, and (3) make a joint recommendation on revisions to the Rules for the Government of Pole Attachments, 150 C.S.R. 38, to address abandoned facilities on utility poles and transfer of facilities on utility poles.

Commission Staff shall serve as chair and administrator of the HB 2002 Task Force. In addition to Staff, the Commission named to the HB 2002 Task Force all incumbent local exchange telecommunication companies, competitive local exchange carriers serving customers through CLEC-owned physical facilities, and electric utilities. The Commission seeks voluntary stakeholder participation from cable television providers, the West Virginia Broadband Council, and the West Virginia Department of Economic Development Office of Broadband.

Anyone desiring to participate on the HB2002 Task Force should file a notice of participation with the Executive Secretary of the Public Service Commission by July 29, 2021. Interested parties that do not participate on the HB 2002 Task Force may file comments at any time.
