NOTICE OF TRUSTEE’S SALE
PUBLIC AUCTION

In execution of a certain Deed of Trust dated August 12, 2015, recorded in the Office of the Clerk of the County Commission of Fayette County, West Virginia, in Trust Deed Book 955, at Page 92, the same being a Second Deed of Trust, given by Wanda E. Meador, to Denise A. Light, Trustee for Fayette County National Bank; said Trustee failing to perform, Paul O. Clay, Jr., Successor Trustee was appointed as evidenced by that certain Removal of Trustee and Substitution Thereof, dated January 25, 2021, and recorded in the aforesaid Clerk’s Office in Trust Deed Book 1041, at Page 439, default having been made in the payment of the debt therein secured; and upon failure to cure said default; and being required by the beneficiary so to do, the undersigned Successor Trustee will sell at public auction on Tuesday August 17th, 2021, at 10:30 o’clock a.m., the following described real estate situate in the City of Oak Hill, Fayette County, West Virginia, and being more particularly bounded and described as follows, to-wit:

BEGINNING at a fence post on Virginia Street, a corner to Clower, and leaving the same N 19-07 W 161.23 feet to a fence post; thence N 48-42 W 141.27 feet to a fence post; thence N 45-20 E 64.0 feet to a fence post; thence S 48-49 E 184.67 feet along the line of Powell to a fence post; thence N 68-51 E 41.39 feet to a fence post; thence S 21-11 E 149.91 feet to a fence post; thence along said Virginia Street S 69-27 W 126.31 feet to the place of beginning; and being further described in that certain plat or map entitled “Map Showing Elizabeth Hindson Property on Virginia Street, Oak Hill, West Virginia, September, 1952,”prepared by Bennett-Perry-Thomas Engineering Company of Oak Hill, WV, file No. A2888.

And being the same real estate conveyed unto Esther Cafego and Wanda Meador (aka Wanda E. Meador) as joint tenants with right of survivorship and not as tenants in common by deed of Esther Cafego dated the 1st day of October, 2007, and recorded in the aforesaid Clerk’s Office in Deed Book 633, at Page 463.

The said Esther Cafego died July 7, 2014, thus vesting full ownership in subject property unto Wanda E. Meador of the first part herein.

The said Wanda E. Meador died testate February 9, 2020, and by the terms of her Last Will & Testament, recorded in the Fayette County Clerk’s Office in Will Book 93, at Page 21, more particularly Article VII thereof, she devised “all of my remaining property, whether real, personal or mixed unto my Trustee hereinafter named…, for the support, maintenance and education of her grandchildren, Seth O’Neil Meador and Quinlan O’Shea Meador, until they have attained the age of 25 years”.

Pursuant to Article VIII, Eric Dean Meador was appointed as Trustee of the aforesaid Trust and upon the death of Eric Dean Meador the alternate Trustee named was Charles L. Eary. The Estate of Wanda E. Meador is currently pending and no Final Settlement has been filed therein.

The above described real estate will be conveyed by the undersigned Successor Trustee to the purchaser thereof by deed containing a covenant of SPECIAL WARRANTY and subject to all liens, reservations and exceptions appearing in the record title, and more particularly that certain First Deed of trust given by Wand E Meador to Frederick A Jesser, III and Denise A Light, dated December 18, 2014, recorded in the Fayette County Clerk’s Office in Trust Deed Book 942, at Page 285, and to the lien of all unpaid taxes, if any, which are entitled to priority over the lien of the aforesaid Deed of Trust.

The Successor Trustee herein asserts, to the best of his knowledge and belief, that the parties in interest are not members of the Armed Forces of the United States, and is therefore not entitled to the benefits of the Service Members Civil Relief Act.

REAL ESTATE TAXES:

Subject property will be sold by the undersigned Successor Trustee subject to real estate taxes presently a lien against subject real property. Any purchaser shall purchase subject to, and be responsible for, said real estate taxes.

TERMS OF SALE:

Cash on hand on day of sale. The above described real estate will be sold by the undersigned Successor Trustee by auction to the highest bidder subject to the right of the Trustee to reject all bids if in his opinion they are inadequate. The owner of the indebtedness secured by the above described Deed of Trust and the owner of any other interest in the property to be sold shall have the right to bid.

The Successor Trustee does not warrant title or fitness to this property; it is being purchased as is; this is a buyer beware sale and any buyer is advised to retain counsel before the sale.

CONTINUANCE OR
ADJOURNMENT OF SALE:

The Successor Trustee reserves the right to continue the sale, or to adjourn the sale, for a time, or from time to time, without further notice and announcement at the time and place of sale, as hereinabove set forth, or any continuance or adjournment thereof.
