NOTICE OF TRUSTEE’S SALE

NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated January 23, 2012, executed by Borrowers, Angel R McCoy and Michael B McCoy, to Vance Golden, the Trustee of record in the office of the Clerk of the County Commission of Wyoming County, West Virginia, in Book 263, at Page 27. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 110 Maple Lane, Clear Fork, WV 24822. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated June 4, 2019, of record in the Clerk’s Office in Book 289, Page 564. The borrowers defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Wyoming County, in Pineville, West Virginia, on the following date:

22nd day of October, 2021
at 12:30 p.m.

The property is described as of that certain 1.00 acre, more or less, piece, parcel or tract of real estate situate, lying and being on the waters of Little Creek of Clear Fork of the Guyandotte River, at Crouch`s Farm, Clear Fork District, Wyoming County, West Virginia, and being more particularly bounded and described as follows, to-wit:

BEGINNING on a Roof Bolt (Found) on the south side of a 30′ access road at the northwestern corner of the Angela Lynn Cline 1.50 acre tract recorded in the Office of the Clerk of the Wyoming County Commission in Deed Book 374 at page 564 and said roof bolt being the northeastern corner of the Dennis Lee Cline 0.33 acre tract recorded in Deed Book 339 at page 749 with reference S 86deg. 43′ E – 93.01′ to a Roof Bolt (Found) at the northwestern corner of the said Dennis Lee Cline tract at the intersection of two 30′ access roads; thence leaving the Dennis Cline tract and with the south side of the said access road and the original boundary line of the said Angela Lynn Cline tract,

N 86deg. 43′ E, 90.00′ to a Roof Bolt (Set) on the south side of said access road 3′ NW of a 10″ Maple, said roof bolt being a new corner on the line of the said Angela Lynn Cline tract; thence, leaving the said access road and the original boundary line of the said Angela Lynn Cline tract and with a new division line traversing the said
Angela Lynn Cline tract and passing at 117.07′ a point on the original division line between the said Angela Lynn Cline and the Casandra Lea Cline acre tract recorded in Deed Book 372 at page 395 and leaving the said original division line and into the said Casandra Lea Cline tract,

S 31deg. 08′ E, for a total distance of 180.98′ to a Roof Bolt (Set) on the new division line; thence, continuing into the said Casandra Lea Cline tract,

S 31deg. 08′ E, 128.1 8′ to a Roof Bolt (Set) 1′ SE of a ditch at the toe of the hill a new corner, thence, continuing on the new division line passing at 51.23′ the original division line between the said Angela Lynn Cline and Casandra Lea Cline tracts,

S 70deg. 31′ W, for a total distance of 180.77′ to a 1″ Solid Steel Pin (Found) 0.5′ outside a fence line, said pin being an original corner on the boundary line of the said Angela Lynn Cline tract; thence, with the said original boundary line,

N 34deg. 32′ W, 166.89′ to a Roof Bolt (Set) in the fence line l’ SW of a 4″ Pine, said roof bolt being a new corner on the said original boundary line; thence, leaving the said original boundary line and with a new line into the said Angela Lynn Cline tract,

N 55deg. 28′ E, 114.52′ to a Roof Bolt (Set) 15′ SW of a driveway, said roof bolt being a new corner; thence, continuing with a new line through the said Angela Lynn Cline tract and passing a 40.73′ a Roof Bolt (Found) a common corner of the said Dennis Lee Cline tract and the said original Angela Lynn Cline tract, and with the original division line between said Dennis Lee Cline and Angela Lynn Cline,

N 34deg. 00′ W, for a total distance of 141.50′ to the Point of Beginning, containing 1.00 acres, more or less, comprised of a 0.11 acres, more or less, being part of the 1.50 acre, more or less, tract of land conveyed to Casandra Lea Cline by deed dated 19th day of May, 1992, recorded in the office of the Clerk of the County Commission of Wyoming County, West Virginia, in Deed Book 372 at page 395 and 0.89 acres, more or less, being part of the 1.50 acre tract of land deeded to Angela Lynn Cline by deed dated the 30th day of December, 1992, recorded in the office of the Clerk of the County Commission of Wyoming County, West Virginia, in Deed Book 374 at page 564 and being shown or designated as Tract 1 on a map or plat entitled: “PLAT OF SURVEY SHOWING THE DIVISION OF THE ANGELA LYNN CLINE AND CASANDRA LEA CLINE TRACTS SITUATE AT CROUCH’S FARM ON THE WATERS OF LITTLE CREEK OF CLEAR FORK OF THE GUYANDOTTE RIVER, CLEAR FORK DISTRICT, WYOMING COUNTY, WEST VIRGINIA, SCALE: 1″ = 50′, DATE: JUNE 26, 1997, SURVEY & MAP BY: ASHRYN SURVEYING,” attached hereto and made a part of this description and recorded in that certain map file No. in the County Clerk’s Office of Wyoming County, West Virginia.

And being the same property acquired by Michael B. McCoy and Angel R. McCoy, husband and wife, by deed dated October 22, 2008, from Gary L. Morgan and Mitzi C. Morgan, husband and wife, recorded in the Office of the Clerk of the County Commission of Wyoming County, West Virginia, in Deed Book 443, at page 102.

TERMS OF SALE:

1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.

2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code § 11-22-1.

3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.

4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.

5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
