NOTICE OF TRUSTEE’S SALE

In execution of the deed of trust, dated December 31, 2007, from Ronald D. Rumley and Marcella L. Rumley to Stephen M. Feola and Gary R. Mills, as trustees, of record in the Office of the Clerk of the County Commission of Mercer County, West Virginia, in Trust Deed Book 1132, at page 462, the undersigned trustee will offer for sale at public auction on February 14, 2022, at 11:00 a.m. at the North Walker Street entrance to the Mercer County Courthouse, Princeton, West Virginia, the following:
PARCEL ONE:

TRACT 1: All those certain lots or parcels of land situate in the Town of Oakvale, Mercer County, West Virginia, which lots consists of Lots Nos. 23 and 24 as shown by a map of said Town of Oakvale, which lots are more particularly described as follows:

BEGINNING at a point where Railroad Avenue intersects with the east side of a twenty five foot alley dedicated to the Town of Oakvale, W.Va. by J. R. Shumate at the time of a sale conducted for said Shumate by Horne y Brothers; thence following the line of said Railroad Avenue in an easterly direction a distance of 125.5 feet to the corner of Lot No. 25, now owned by T. C. Price; thence in a southerly direction with the line of Lot No. 25 a distance of 175 feet to the center of East River; thence in a westerly direction 126 feet with said center of East River to the above mentioned alley; thence in a northerly direction 171 feet by a large pinoak tree, which tree is included in this conveyance, to the point of BEGINNING.

TRACT 2: Part of Lot One, being known as Lot No. 26 on the south side of the Norfolk & Western Railway, in said town and Parcel or Lot Two, being known as Lot No. 25, on the south side of the Norfolk and Western Railway and adjoins Lot No. 26, described above.

TRACT 3: All that certain lot or parcel of land situate and being in the Town of Oakvale, Mercer County, West Virginia, and known as Lot No. 27 and on the South side of the N & W Railway.

Being ALL and the SAME real estate acquired by Ronald D. Rumley and Marcella L. Rumley from Giles L. Lester, Jr., by deed dated April 23, 1996, which is of record in the Mercer County Clerk’s Office in Deed Book 770 at Page 117.

PARCEL TWO:

That certain alleyway 25 feet in width and extending approximately 115 feet from the southern line of Railroad Avenue to the north bank of East River; be and the same is hereby vacated, closed and abandoned to the owners of the property abutting thereto, being Ronald D. Rumley and Marcell Rumley, subject to a perpetual easement running in favor of the town of Oakvale for the construction and maintenance of sewer lines, water lines and all other utility lines.

Being ALL and the SAME real estate acquired by Ronald D. Rumley and Marcell Rumley from the Common Council of the Town of Oakvale by an Ordinance To Abandon An Unused Alleyway Extending From railroad Avenue to east River dated the 3rd day of May, 1999, of record in the Mercer County Clerk’s Office in Deed Book 808 at Page 587.

PARCEL THREE:

Those three certain lots located in the Town of Oakvale, Mercer County, West Virginia, designated as Lots 3, 4 and 5, as sold by Horne y Brothers, October 8, 1923, and so designated by Map recorded in the Office of the Clerk of the County Commission, Mercer County, West Virginia, and more fully described as follows:

LOT NO. 3: BEGINNING at an iron stake where the northwest corner of a 25 ft. alley intersects with Railroad Avenue, thence S. 12 degrees E. with the west side of said alley to East River, thence up East River 50 ft. to a stake, thence N. 12 degrees W. to a stake in the south line of Railroad Avenue, thence eastward with the south line of Railroad Avenue to the BEGINNING.

LOT NOS. 4 & 5: BEGINNING 50 ft. west of an iron stake at the intersection of a 25 ft. alley with Railroad Avenue; thence South 12 degrees with the west side of Lot No. 3 to East River, thence up East River 100 ft. to a stake in the southeast corner of Lot No. 6, thence N. 12 degrees W. to a stake in the south line of Railroad Avenue, thence with this south line of Railroad Avenue eastward 100 ft. to the BEGINNING corner.

Being ALL and the SAME real estate acquired by Ronald D. Rumley and Marcella L. Rumley from Giles L. Lester, Jr., by deed dated April 23, 1996, which is of record in the Mercer County Clerk’s Office in Deed Rook 770 at Page 120.

PARCEL FOUR:

certain real estate situate in the Town of Oakvale, Mercer County, West Virginia, which is described as follows:

BEGINNING at a point, the northwest corner of Martha Ramsey’s land, thence in a western direction 2012 feet, more or less, running with the property lines of the Johnston Estate, T. C. Price, B. F. Boggess, O. S. Boggess, W. L. Boyd, and Lots Nos. 7 and 8, W. M. Smith, Zura Perdue, Lot No. 16, L. L. Vaught, O. S. Boggess, Pete Harry, Lots Nos. 23, 24, and 25, and Otis Richard (the above named lines being called herein instead of ‘The Middle of East River’, as called for in former deeds); thence with Ida Hearn Bell’s line in a southern direction to a hickory and hazelnut bush in the D. A. Johnston line; thence in an eastern direction, with the D. A Johnston line, to a crosscut in a limestone rock in the Martha Ramsey line, and a corner with her; thence in a northern direction, running with said line to the point of BEGINNING, containing 37.1 acres, more or less.

There is expressly excepted and reserved from this conveyance that certain parcel conveyed unto the Town of Oakvale by deed dated January 28, 1950, recorded in Deed Book 311, at Page 77, for the widening of Railroad Avenue.

Being ALL and the SAME real estate acquired by Ronald D. Rumley and Marcella Rumley from Doris I. Brinkley, by deed dated April 7, 1997, which is of record in the Mercer County Clerk’s Office in Deed Book 781 at page 50.

The deed of trust states that the address of this real estate is commonly known as 142 Railroad Avenue, Oakvale, West Virginia 25820.

J. Peter Richardson was appointed substitute trustee by the APPOINTMENT OF SUBSTITUTE TRUSTEE, dated May 21, 2019, of record in said Clerk’s Office in Trust Deed Book 1375, at page 109.

This sale will include all rights, easements, appurtenances, improvements and structures that are part of the real estate described above. This sale will be subject to all restrictions, rights-of-way, conditions, easements and matters of record, mechanics’ and materialmen’s liens, if any, whether of record or not of record, and unpaid real estate taxes, to the extent any of the foregoing apply and take priority over the lien of the deed of trust.

TERMS OF SALE: Cash in hand on day of sale. The conveyance of the real estate will be by a deed without any covenant or warranty, express or implied. The real estate and any improvements thereon will be sold in “as is” condition without any warranties. The successful bidder will assume the risk of all loss or damage to the real estate and any improvements thereon after the sale, and be responsible for all costs of the conveyance including, but not limited to, any examination of title, preparation of the deed, excise tax and recording fees. Any announcements made at the sale, including postponement of the sale and withdrawal of the real estate from sale, will take priority over published notices.
