LEGAL NOTICE
REQUEST FOR PROPOSALS FOR LEGAL SERVICES

The Mercer County Commission, West Virginia is in the process of obtaining legal services necessary to complete an ARC POWER Initiative Broadband Expansion Project. The Project Attorney will work closely with Mercer County Commission, Region I Planning & Development Council, and the selected Engineering Firm.

The Project Attorney is an integral part of the project team and will provide general legal services as necessary during the development and construction of the project. Areas of practice include but are not limited to necessary title work to obtain construction rights-of-way and parcels, and review of all contracts and related documents.

Procurement of the said services shall be in accordance with 2 CFR 200.320 (d). The contract will be awarded to the responsible offeror whose proposal is within the competitive range and determined to be the most advantageous to the project, price and other factors considered including familiarity and expertise with this type of project.

All those interested in being considered must submit a proposal detailing qualifications and staffing capabilities, related prior work experience, fee schedule and ability to complete work as needed on this project in a timely manner.

Interested firms must submit one (1) original, three (3) copies, and one (1) digital format submission of all requested information to: Mercer County Commission, RFP for Legal – ARC POWER, 1501 West Main Street, Princeton, WV 24740 and one (1) copy and one (1) digital submission should also be sent to: Region I Planning & Development Council, RFP for Legal – ARC POWER, 1439 E. Main Street, Suite 5, Princeton, WV 24740 with the digital submission being emailed to [email protected]. The deadline for receipt of proposals is 4:00 p.m. on May 31, 2022.

Attention is directed to the fact that the proposed project may be undertaken through funding sources including, but not limited to an ARC POWER Initiative Grant. All work will be performed in accordance with the regulations issued by the funding agency and the State of West Virginia appertaining thereto.

The Mercer County Commission will afford full opportunity for minority business enterprises to submit a show of interest in response to this invitation and will not discriminate against any interested firm or individual on the grounds of race, color, creed, sex, age, handicap or national origin in the contract award.

The Mercer County Commission reserves the right to accept or reject any and/or all proposals. The Mercer County Commission also reserves the right to negotiate the fee for services.
