TRUSTEE’S SALE OF
VALUABLE REAL ESTATE
The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated November 27,2019, and duly recorded in the Office of the Clerk of the County Commission of Marion County, West Virginia, in Deed of Trust Book 1235, at Page 259, Jason L. Rush and Misty M. Rush did convey unto Jeffrey S. Compton, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Marion County Courthouse, in Fairmont, West Virginia, on

The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Winfield District, Marion County, West Virginia, and more particularly described as follows:
All that certain lot or parcel of real estate, lying and being situate in the Winfield District, Marion County, West Virginia, and being more particularly described as follows, to-wit:
Beginning at a 5/8″ x 30″ iron rod set in line of Huffman, being the northeastern comer of Tract 1, and running thence with said Huffman N. 73deg. 59′ 35″ E. 421.40 feet to a 5/8″ x 30″ iron rod set, being the northwestern corner of Tract 3; thence with line of said Tract 3 S. 16deg. 33′ 30″ E. 726.59 feet to a 5/8″ x 30″ iron rod set in line of R. Rush; thence with said line of R. Rush S. 62o6′ 58″ W. 263.43 feet to a y,” iron rod found; thence with line of G. Rush S. 76deg. 02′ 53″ W. 162.53 feet a 5/8″ x 30″ iron rod set, being the southeastern corner of Tract 1; thence with line of said Tract 1 N. 16deg. 33′ 30″ W. 771.22 feet to the place of beginning, containing 7.07 acres, more or less, which real estate is shown and designated as Tract 2 on the map or plat of record in the Office of the County Commission of Marion County, West Virginia, in Deed Book 1038, at page 859.

AND BEING the same real estate which was conveyed to Jason L. Rush and Misty M. Rush, by Deed dated July 28, 2008, from Earl V. Rush, Jr. Tammy S. Rush, Steven A. Rush, Connie C> Rush, Karen M. Sanders, Kenneth W. Sanders, Richard L. Rush, Sarah M. Rush, M. Ray Rush, Cynthis S. Rush, Jason L. Rush, and Tina D. Rush, and recorded in the Office of the Clerk of the County Commission of Marion County, West Virginia, in Deed Book 1038 at Page 854.
The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: Ten percent (10%) of the purchase price as a deposit with the balance due and payable within 30 days of the day of sale.
