TRUSTEE’S SALE OF
VALUABLE REAL ESTATE

The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated March 28, 2014, and duly recorded in the Office of the Clerk of the County Commission of Mercer County, West Virginia, in Document No. 573543, in Book No. 1272, at Page 633, Gary F Sanders did convey unto Gary R. Mills, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by PennyMac Loan Services, LLC to foreclose thereunder, will offer for sale at public auction at the front door of the Mercer County Courthouse in Princeton, West Virginia, on

April 25, 2023 at 10:00 AM

the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in 02-Beaver Pond District, Mercer County, West Virginia, and more particularly described as follows:

All that certain lot or parcel of land, with the improvements thereon and appurtenances thereunto belonging, shown as LOT 1 upon a Map of the Walter J. and Mildred Eula Hayton 3.07 acre tract of land on the Old Bluefield-Princeton Macadam Road, Beaver Pond District, Mercer County, West Virginia, Scale 1″=50′, April 15, 1953, Elmer C. Barton, Civil Engineer, which is of record in the office of the Clerk of the County Court of Mercer County, West Virginia, in Map Book No. 2, page 264, more particularly bounded and described as follows:

“BEGINNING at an iron pin at the point of intersection of the southern right-of-way of the Old Bluefield-Princeton Macadam road (formerly the Princeton Power Company right-of-way line), with the Northeast line of a roadway 20 feet in width; thence along the said southern right-of-way of said former Power Company line, N. 15deg. 51′ E. 48.8 feet to an iron pin; thence N. 18deg. 18′ E. 64.6 feet to an iron pin at a corner of Lot 2 of said Sub-division; thence along the Southwest line of said Lot 2, S. 51deg. 46′ E. 311 feet, more or less, to a point in the center line of Brush Creek; thence along and with said Creek, S. 30deg. 58′ W. 110 feet, more or less, to a point in the Northeastern line of said above mentioned 20 feet wide roadway; thence along roadway N. 52deg. 30′ W. 290 feet, more or less, to the point of BEGINNING, and containing 0.7 of an acre.”

And being the same property conveyed unto Trustees of the Delmar G. Jones and Nancy L. Jones Revocable Trust from Mildred Fernsell and Michael Ringstaff by deed dated the 25th day of August, 2009, of record in the office of the Clerk of the County Commission of Mercer County in Deed Book 941 at Page 257. Delmar G. Jones dies October 24, 2008; thereby extinguishing his responsibilities as Trustee of the Delmar G. Jones and Nancy L. Jones Revocable Trust.

This conveyance is made subject to an easement to Green Valley-Glenwood Public Service District, of record in said Clerk’s Office in Deed Book 407, at page 550.

There is hereby excepted and reserved from this conveyance a 0.40 acre parcel, more or less, heretofore conveyed by Mary Etta Myers to William E. Pruett and Teresa M. Pruett, his wife, by deed dated June 2, 1978, of record in said Clerk’s Office in Deed Book 564, at page 534.

At the time of the execution of the Deed of Trust, this property was reported to have an address of: 994 Mercer Mall Road, Bluefield, WV 24701.

The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.

The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

TERMS: $5000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale.

FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.

Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
