Notice is hereby given that SHANE COAL COMPANY, PO BOX 1084, 356 S COLLEGE AVE, BLUEFIELD VA 24605 has a permit on file with the Department of Environmental Protection (DEP) for the surface mining of approximately 25.23 acres and has submitted an application to the DEP., 1159 Nick Rahall Greenway, Fayetteville, WV, 25840, for renewal of Article 3 Permit Number U400308 to operate an underground coal mine in the Sewell seam of coal. The operation is discharging into Brier Creek of Indian Creek of the Guyandotte River and Davy Branch of Tug Fork River and is located 2.4 miles, Northeast of Davy and 3.18 miles Southeast of Fanrock in Browns Creek and Baileysville District of McDowell and Wyoming County, Longitude 81o37’23” and Latitude 37o30’26” (Coordinates from USGS Topographic Map).

Written comments and/or requests for an informal conference of the permit renewal application shall identify the applicant and application number and will be received by the Permit Supervisor at the DEP address above until May 27, 2023, or thirty (30) days from the date of final publication.
