In execution a certain Deed of Trust dated December 24, 2020, the original principal amount of $815,000.00, and recorded as Instrument No. 200003576 in the Clerk’s Office of the Circuit Court of Tazewell County, Virginia, the Substitute Trustee will offer for sale at public auction on the front steps of the Tazewell County Courthouse located at 135 Court Street, Tazewell, Virginia 24651 on May 1, 2023 at 11:00 a.m. the property more particularly described in the aforementioned Deed of Trust, located at the property address listed below and briefly identified as follows: All that certain real estate, together with all appurtenances thereupon and easements benefiting the same, situate and being in the Town of Richlands, in the Maiden Springs Magisterial District of Tazewell County, Virginia, which property is more particularly described as follows: Parcel 1: All those certain Lots Nos. 71, 72, 73 and 74, as shown on that plat entitled “MAP OF SUBDIVISION “A” FLORENCE R. CRABTREE LANDS (PATTON J. BROWN EST.) RICHLANDS, VIRGINIA,” which plat with certificate is of record in the Clerk’s Office of the Circuit Court of Tazewell County, Virginia in Deed Book 175, pages 418 and 419, reference to which is here made. Parcel 2: All that certain tract or parcel of land consisting of a fifty foot (50′) wide strip of land adjoining the eastern most boundary of Lots Nos. 71, 72, 73 and 74, and being a portion of Lot 89 and Lot 94, and which fifty foot (50′) strip of land is more particularly described as follows: BEGINNING at a point situate in the southeast corner of Lot 71 and which point is also in the western most line of Lot 89; thence continuing in a straight line, being the same as the division line between Lots 70 and 71; N. 70deg. 43′ E. 50.00′ to a point situate in the division line between Lots 89 and 90; thence with the said division line between Lots 89 and 90 and Lots 94 and 95, N. 12deg. 15′ W. 100.00 feet to a point situate in the division line between Lots 94 and 95; thence S. 70deg. 43′ W. 50.00′ to a point situate in the northeast corner of Lot 74 (being a common corner to Lot 75); thence with the eastern most line of Lots 74, 73, 72 and 71, S. 19deg. 15′ E. 100.00 feet to the point of BEGINNING. Parcel 4: The remaining portion of Lot 94 as owned by the Grantors, being the northern half of said Lot 94, and all of Lots Nos. 70, 75, 76, 77, 95, 96, 97 and 98, as shown on that plat entitled “MAP OF SUBDIVISION “A” FLORENCE R. CRABTREE LANDS (PATTON J. BROWN EST.) RICHLANDS, VIRGINIA,” which plat with certificate is of record in the Clerk’s Office of the Circuit Court of Tazewell County, Virginia in Deed Book 175, pages 418 and 419, reference to which is here made. Parcel 5: A fifty foot (50′) wide strip of land being the northern most fifty foot (50′) portion of Lots Nos. 90, 91, 92 and 93, which strip of land adjoins the southern boundary of Lot 89, which twenty-five foot (25′) wide strip of land adjoins and is adjacent to the eastern boundary of Lot 70, as shown on that plat entitled “MAP OF SUBDIVISION “A” FLORENCE R. CRABTREE LANDS (PATTON J. BROWN EST.) RICHLANDS, VIRGINIA,” which plat with certificate is of record in the Clerk’s Office of the Circuit Court of Tazewell County, Virginia in Deed Book 175, pages 418 and 419, reference to which is here made. AND BEING the same tracts and parcels of land conveyed by Robert Andrew Altizer, Christi Celina Altizer and Altizer Properties & Investments to Frazier Tire and Automotive, Inc. by Deed dated the 7th day of January, 2020, and recorded on the 8th day of January, 2020 in the Clerk’s Office of the Circuit Court of Tazewell County, Virginia in Deed Book 2020, page 00205, reference to which is hereby made for a more particular description of the property herein conveyed. Address: 2311 3rd St., Richlands, VA 24641. The property will be sold “AS IS” WITHOUT REPRESENTATION OR WARRANTY OF ANY KIND AND SUBJECT TO conditions, covenants, restrictions, reservations, easements, rights of way, and all other matters of record taking priority over the Deed of Trust, if any, as might be listed in this notice or might be announced at sale. TERMS OF SALE: A non-refundable bidder’s deposit in the amount of $81,500.00 or 10% of the sale price, whichever is less, by cashier’s or certified check required at the time of sale, except for the party secured by the Deed of Trust. Risk of loss is on the purchaser from the date and time of auction. Balance of the purchase price must be paid by cashier’s check within 14 days from the sale date. Except for Virginia Grantor tax, all settlement costs and expenses are purchaser’s responsibility. Taxes are pro-rated to the date of sale. If purchaser defaults, deposit may be forfeited and property resold at the risk of and cost of the defaulting purchaser who shall be liable for any deficiency in the purchase price and all costs, expenses and attorneys’ fees of both sales. If Trustee does not convey title for any reason, purchaser’s sole remedy is return of deposit without interest. This sale is subject to post-sale audit of the status of the loan secured by the Deed of Trust including but not limited to whether prior to sale, the loan was repaid or reinstated or the property became subject to an automatic stay under the U.S. Bankruptcy Code; in any such event, this sale shall be null and void and purchaser’s sole remedy shall be return of deposit without interest.
