TRUSTEE’S SALE OF
VALUABLE REAL ESTATE

The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated July 10, 2015, and duly recorded in the Office of the Clerk of the County Commission of Mercer County, West Virginia, in Document No. 628283, in Book No. 1299, at Page 49, Joshua Honaker did convey unto Douglas McElwee, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by Rocket Mortgage, LLC f/k/a Quicken Loans, LLC f/k/a Quicken Loans Inc. to foreclose thereunder, will offer for sale at public auction at the front door of the Mercer County Courthouse in Princeton, West Virginia, on

the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in 03 – Bluefield District, Mercer County, West Virginia, and more particularly described as follows:

“all that certain tract or parcel of real estate, together with the improvements thereon, situate in the City of Bluefield, Mercer County, West Virginia, designated as Lots 5, 6 and 7, Section 865, as shown on map entitled ‘PLAT SHOWING LOT NUMBERS 5, 6 & 7 OF SECTION 865, 2223 JEFFERSON STREET, BEAVER POND DISTRICT, MERCER COUNTY, BEING SITUATE IN THE CITY OF BLUEFIELD, WEST VIRGINIA’, prepared by Shields Engineering Co., LLC, dated July 27, 1999, which map is of record in the Mercer County Clerk’s Office as Microfilm Plat No. 13904”, and more particularly bounded and described as follows:
“BEGINNING at a ½” iron pipe found in the northeastern right-of-way of Jefferson Street and at a common corner of Lots 4 and 5 and at the southeast corner of Karen E. Simmons; thence with a common line of said Lots 4 and 5 and with the southeastern line of said Simmons N. 44deg. 56′ E. 144.90 feet to a ½” iron pipe found at the northeast corner of said Simmons and being a common corner of said Lots 4 and 5 and in the southwestern right-of-way of a 10′ wide alley; thence with the northeastern line of said Lot 5 then changing to the northeastern line of Lots 6 and 7 and with the southwestern line of said alley, S. 45deg. 18′ E. 150.00 feet to a ½” iron pipe found in the southwestern line of said alley and at a common corner of Lots 7 and 8 and northwest corner of Lewis and Elizabeth Haynes; thence with a common line of said Lots 7 and 8 and with the northwestern line of said Haynes, S. 44deg. 56′ W. 145.40′ to a ½” rebar found at southwest corner of said Haynes and at a common corner of said Lots 7 and 8 and in the northeastern line of said Jefferson Street; thence with the southwestern lines of said Lots 7, 6 and 5, and the northeastern line of said Jefferson Street, N. 45deg. 04′ W. 150.00 feet to the point of BEGINNING, and containing 0.50 acres, more or less.”
And being the same property conveyed to Joshua Honaker and Paige Honaker, husband and wife, by Irma Jean Howington, by Deed dated June 10, 2015, to be recorded in the Office of the Clerk of the County Commission of Mercer County, West Virginia, simultaneously with this instrument.
“This conveyance is subject to all pertinent easements, restrictions and reservations of record.”

At the time of the execution of the Deed of Trust, this property was reported to have an address of: 2223 Jefferson St, Bluefield, WV 24701-4709.

The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.

The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

TERMS: $5000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale.

FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.

Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
