General Notice
Town of Union (Owner) is requesting Bids for the construction of the following Project:

Contract #1 – Pickaway Waterline Extension
Contract #2 – Water Storage Tank
Thrasher Project #010-00428

Bids for the construction of the Project will be received at the Town of Union located at 10 Pump Street, Union, West Virginia, 24983, until Tuesday, June 20, 2023, at 2:00 PM local time. At that time the Bids received will be publicly opened and read.

The Project includes the following Work:

Contract #1:

This contract will construct of waterline, valves, and associated equipment to serve residents and commercial businesses along Route 219 beginning where it intersects with Stringtown Road and running just past where it intersects Neff Orchard Road. At this point, a single lane access road will be constructed within this contract to connect to a proposed water storage tank being constructed in Contract #2.

Contract #2:

This contract will include the site development and installation of a 100,000-gallon water storage tank, valve vault, and control panel structure.

Separate Bids will be received for the following Contracts:

The Work will be substantially completed within 270 days for Contract #1 and 270 days for Contract #2 after the date when the Contract Times commence to run, and completed and ready for final payment within 300 days for Contract #1 and 300 days for Contract #2 after the date when the Contract Times commence to run. Liquidated damages shall be $1,000/day for both Contract #1 and Contract #2.

Bidding Documents may be downloaded from the designated website. Prospective Bidders are urged to register with the designated website as a plan holder, even if Bidding Documents are obtained from a plan room or source other than the designated website in either electronic or paper format. The designated website will be updated periodically with addenda, lists of registered plan holders, reports, and other information relevant to submitting a Bid for the Project. All official notifications, addenda, and other Bidding Documents will be offered only through the designated website. Neither Owner nor Engineer will be responsible for Bidding Documents, including addenda, if any, obtained from sources other than the designated website.

Prospective Bidders may obtain or examine the Bidding Documents at the Issuing Office on Monday through Friday between the hours of 8:00 am to 5:00 pm, and may obtain copies of the Bidding Documents from the Issuing Office as described below.

Printed copies of the Bidding Documents may be obtained from the Issuing Office by paying the amount of each set listed below.

Bidding Documents may be purchased from the Issuing Office during the hours indicated above. Cost does not include shipping charges. Upon Issuing Office’s receipt of payment, printed Bidding Documents or electronic documents will be transmitted to the prospective Bidder. The shipping charge amount will depend on the shipping method requested. Bidding Documents are available for purchase in the following formats:

— Bidding Documents issued as hard copy full-size drawings and hard copy specifications, are available for $150.00 per set.

Amounts paid are not subject to refund.

A two envelope system will be used.

Envelope No. 1 must have the following information presented on the front:

Name and address of Bidder
Bid on Contract – Contract #1 – Pickaway Waterline Extension
Contract #2 – Water Storage Tank
Received by the Town of Union

Envelope No. 2 labeled “Bid Proposal” shall also be placed inside of Envelope #1.

Envelope No. 1 will be opened first and the Bid Opening Requirement items checked for compliance as outlined on the Bid Opening Checklist on page BOR – 1 of these contract documents. If such documents are found to be in order, Envelope No. 2 “Bid Proposal”, will then be opened and will be publicly read aloud. If the documents required to be contained in Envelope No. 1 are not in order, Envelope No. 2 “Bid Proposal” will not be opened and the Bid will be considered non-responsive and will be returned to the Bidder.

Bidders are advised that the Contract awarded under this Advertisement for Bids is to be funded (entirely/or in part) by a grant from the United States Department of Housing and Urban Development (HUD). Neither the United States nor any of its departments, agencies, or employees is or will be a party to this Advertisement for Bids or any resulting Contract.

This Small Cities Block Grant project is to be financed in part by a grant from the U.S. Department of Housing and Urban Development (HUD) and the West Virginia Development Office and shall be referred to as Project #010-00428.

Bidders on this Work will be required to comply with the President’s Executive Order No. 11246 and “HUD Section 109”, which prohibits discrimination in employment regarding race, creed, color, sex, or national origin.

The work to be performed under this Contract is subject to the requirements of Section 3 of the Housing and Urban Development Act of 1968, as amended, 12 U.S.C. 1701 u (Section 3). The contractor will ensure that to the greatest extent feasible opportunities for training and employment arising in connection with this SCBG-assisted project will be extended to lower income project area residents. Further, the contractor will, to the greatest extent feasible, utilize business concerns located in or substantially owned by residents of the project area, in the award of contracts and purchase of services and supplies.

The parties to this Contract agree to comply with HUD’s regulations in 24 CRF part 135, which implement Section 3. Bidder’s attention is directed to the Section 3 “Clause” set forth in the Contract Documents.

Bidders must comply with the requirements for Affirmative Action and Minority Business Enterprise participation as described in the Federal Specifications insert to the Contract Documents. Bidders must comply with Title VI of the Civil Rights Act of 1964, the Davis Bacon Act, the Copeland Act, the Contract Work Hours and Safety Act, and the West Virginia Division of Labor Wages for Construction of Public Improvements pursuant to West Virginia Code §21-5A-3.

“DBE REQUIREMENTS”

Each Bidder must fully comply with the requirements, terms, and conditions as set forth in the contract documents to achieve Disadvantaged Business Enterprise (DBE) participation during the performance of this contract. The bidder commits itself to the program for DBE participation and all other requirements, terms, and conditions of the bid conditions by submitting a properly signed bid.
The bidder agrees to make “good faith efforts” to sub-contract a portion of the total value of the contract to disadvantaged businesses. This shall be done in compliance with the six (6) affirmative steps as outlined in 40 CFR 31.36(e). Failure to demonstrate positive efforts to do so may lead to rejection of bids. For the purpose of this program, the term “subcontractor” includes all construction, modification, and service work contracted for by the bidder in the execution of the work under this contract.

“NONDISCRIMINATION IN EMPLOYMENT”

“Bidders on this work will be required to comply with the President’s Executive Order No. 11246 and “HUD Section 109″, which prohibits discrimination in employment regarding race, creed, color, sex, or national origin. The requirements for bidders and contractors under this order are explained in the specifications.”

This construction of this project will be funded in part with funds made available from the Federal Government through the US Army Corps of Engineers Section 571 program. Bidders must comply with all applicable laws and regulations for construction projects receiving Federal aid including, but not limited to, the Civil Rights Act of 1964, the Contract Work Hours and Safety Standards Act, and the Davis-Bacon Act as amended.

This construction of this project will be funded in part with funds made available from the Federal Government through the US Army Corps of Engineers Section 340 program. Bidders must comply with all applicable laws and regulations for construction projects receiving Federal aid including, but not limited to, the Civil Rights Act of 1964, the Contract Work Hours and Safety Standards Act, and the Davis-Bacon Act as amended.

A bidder may not withdraw his bid for a period of ninety (90) days after the date set for the opening of bids.

Bids shall be accompanied by a certified check or bid bond payable to Town of Union in an amount equal to five percent (5%) of the base bid.

Contractor is required to provide the Drug Free Workplace Certification in accordance with WV Code 21-1D-5.

All Bidders are required to have a West Virginia Contractor’s License per Section §30-42-12 of the West Virginia Code.

Bids received after the scheduled closing time for the reception of bids will be returned unopened to the bidders.

The Town of Union reserves the right to reject any and all bids.

Pre-bid Conference

A pre-bid conference for the Project will be held on Tuesday, June 6, 2023, at 10:00 PM at Town of Union, 10 Pump Street, Union, WV, 24983. Attendance at the pre-bid conference is encouraged but not required.
