In execution of a certain Deed of Trust dated September 14, 2010, in the original principal amount of $106,564.00 recorded in the Clerk’s Office, Circuit Court for Tazewell County, Virginia, in Book 1081 at Page 0793 as Instrument No. 100003236 . The undersigned Substitute Trustee will offer for sale at public auction in the front of the Circuit Court building for Tazewell County, 101 Main Street, Courthouse Building, Tazewell, Virginia on August 14, 2023, at 12:30 PM, the property described in said Deed of Trust, located at the above address, and more particularly described as follows: ALL THAT CERTAIN TRACT OR PARCEL OF LAND TOGETHER WITH THE IMPROVEMENTS THEREON AND THE APPURTENANCES THEREUNTO BELONGING, AND SUBJECT TO THE RESTRICTIONS AND RESERVATIONS FOUND OF RECORD IN THE CLERK`S OFFICE OF THE CIRCUIT COURT OF TAZEWELL COUNTY, VIRGINIA, SAID PROPERTY BEING SITUATE, LYING AND BEING IN THOMPSON VALLEY, TAZEWELL COUNTY, VIRGINIA, KNOWN AND DESIGNATED AS TRACT NO. 25, CONTAINING 5.003 ACRES, AS SHOWN, DESIGNATED AND DESCRIBED ON A CERTAIN PLAT ENTITLED, “REBECCA A. ASBURY AND BANE F. ASBURY, ESTATE”, WHICH PLAT IS FOUND OF RECORD IN THE AFORESAID CLERK`S OFFICE IN PLAT BOOK 11, PAGES 18 AND 19, AND ON PLAT CARDS NOS. 3596 AND 3597. THERE IS HEREBY EXCEPTED AND RESERVED FROM THIS CONVEYANCE THAT PORTION OF PROPERTY THAT WAS CONVEYED TO JOHNNY PHILIPS AND LINDA PHILLIPS BY DEED DATED MARCH 31, 2008, AND OF RECORD IN THE AFORESAID CLERK`S OFFICE ON MARCH 31, 2008, IN DEED BOOK 1025, PAGE 172. TERMS OF SALE: ALL CASH. A bidder’s deposit of ten percent (10%) of the sale price or ten percent (10%) of the original principal balance of the subject Deed of Trust, whichever is lower, in the form of cash or certified funds payable to the Substitute Trustee must be present at the time of the sale. The balance of the purchase price will be due within fifteen (15) days of sale, otherwise Purchaser’s deposit may be forfeited to Trustee. Time is of the essence. If the sale is set aside for any reason, the Purchaser at the sale shall be entitled to a return of the deposit paid. The Purchaser may, if provided by the terms of the Trustee’s Memorandum of Foreclosure Sale, be entitled to a $50 cancellation fee from the Substitute Trustee, but shall have no further recourse against the Mortgagor, the Mortgagee or the Mortgagee’s attorney.
