TRUSTEE’S SALE

5055 BF Buchanan Highway, Tazewell, VA 24651

In execution of the Deed of Trust in the original principal amount of $149,000.00 dated December 20, 2019 and recorded in Book 2019, Page 17121, as Instrument No. 190003268, of the Tazewell County land records, the appointed Substitute Trustee will offer for sale at public auction at the front steps of the Tazewell County Courthouse, 101 E Main Street, Suite 202, Tazewell, Virginia 24651 on July 13, 2023 at 2:30 PM, the property described in said deed of trust, located at the above address and more particularly described as follows::

All that certain lot or parcel of land situate lying and being in Thompson Valley, in the Jeffersonville Magisterial District of Tazewell County, Virginia, containing two (2) acres, more or less, (this being a sale in gross and not by the acre), and being more particularly bounded and described as follows, to wit: “Beginning at a point in the south side of right of way of State Highway 16, a corner to the W. M. Bowling land (now by recent purchase W. O. Spence’s) thence N. 75deg. E. 224 feet with southside right of way line of said highway to a gate post on same; thence leaving said right of way line S. 20deg. E. 387 feet to a point marked by a planted stone and corner to Elsie T. Bundy land; thence S. 75deg. W. 224 feet to a point in said W. M. Bowling line (now W. O. Spence line); and thence N. 20deg. W. 387 feet to the said beginning point in said highway, southside line”. And being the same property conveyed by Michael Deangelo and Lisa K. Deangelo, to Steven Stiltner by deed dated May 14, 2010 and recorded May 17, 2010 in the office of the aforementioned Clerk’s Office, in Deed Book 1074, Page 0935, reference to which is hereby made for a more particular description of the property herein conveyed. This conveyance is made subject, however, to all easements, conditions, restrictions, and reservations appearing of record which now affect said property.

The property and improvements will be sold in “as is” physical condition without warranty of any kind.

TERMS OF SALE: A non-refundable bidder’s deposit of 10% of the sale price or 10% of the original principal amount of the subject Deed of Trust, whichever is lower, by cashier’s or certified check, required at time of sale except for the party secured by the Deed of Trust. Risk of loss on purchaser from date and time of auction. Balance of the purchase price must be paid by cashier’s check within 15 days from sale date. Except for Virginia Grantor’s tax, all settlement costs and expenses are purchaser’s responsibility. Taxes are pro-rated to the date of sale. Purchaser is responsible for obtaining possession of the property. If purchaser defaults, deposit may be forfeited and property resold at the risk and cost of the defaulting purchaser who shall be liable for any deficiency in the purchase price and all costs, expenses and attorney’s fees of both sales. If Trustee does not convey title for any reason, purchaser’s sole remedy is return of deposit without interest. This sale is subject to post-sale audit by the Substitute Trustee of the conduct of the auction itself as well as the status of the loan secured by the Deed of Trust, including, but not limited to, determining whether prior to sale a bankruptcy was filed, a forbearance, repayment or other agreement was entered into or the loan was reinstated or paid off; in any such event this sale shall be null and void and purchaser’s sole remedy shall be return of deposit without interest. This communication is from a debt collector and is an attempt to collect a debt and any information obtained will be used for that purpose.
