NOTICE OF TRUSTEE’S SALE
NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated May 31, 2016, executed by Borrowers, Richard L Chambers Jr and Doris Ann Chambers, to Golden & Amos, PLLC, the Trustee of record in the office of the Clerk of the County Commission of Raleigh County, West Virginia, in Book 5062, at Page 5164. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 2063 Flat Top Road, Ghent, WV 25843. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated July 14, 2020, of record in the Clerk’s Office in Book 5072, Page 0875. The borrowers defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Raleigh County, in Beckley, West Virginia, on the following date:

The following described tract of land, located in Shady Spring District, Raleigh County, West Virginia, and being more particularly bounded and described as follows:
Parcel 1:
Beginning at an iron pipe on the line of Dennis and Lakie Griffith 10 acre tract, which iron pipe is on the Northeast Corner of the Robert and Wanda Sweeney 0.67 acre tract; thence with the Dennis and Lakie Griffith 10 acre tract, S. 65 degrees 58 minutes E. 1085.48 feet to a stake in the center of Glade Creek; thence down Glade Creek S. 33 degrees 15 minutes W. 98.78 feet to a stake; thence continuing with the center of Glade Creek, S. 17 degrees 27 minutes W. 42.78 feet to a stake; thence leaving Glade Creek and through property owned by the parties of the first part, N. 65 degrees 58 minutes W. 1078.21 feet to a stake; thence N. 25 degrees 40 minutes E. 40 feet to a stake which is the southeast corner of the Robert and Wanda Sweeney 0.67 acre tract; thence with the eastern line of the said Sweeney tract, N. 25 degrees 40 minutes E. 100 feet back to the place of beginning, containing 3.48 acres, more or less.
In addition to the above; the said party of the first part does hereby grant unto the said parties of the second part, all of her interest in a right of way over a forty (40) foot strip of land, the said right of way seine for the purpose of ingress and egress from U.S. Highway 19-21 to the property herein conveyed, and which said right of way is over the following described tract of land; to-wit:
Beginning at a stake on the eastern right of way line of U.S. Highway 19-21 a corner to the Robert and Wanda Sweeney 0.67 acre tract; thence with the southern line of the Robert and Wanda Sweeney tract, S. 65 degrees 01 minutes E. 294.39 feet to a stake, which is the southeast corner of said Sweeney tract; thence with the western line of part of the property above described, S. 25 degrees 40 minutes W. 40 feet to a stake; thence leaving the 3.48 acre tract hereinabove described, N. 65 degrees 01 minutes W. 283.80 feet to a stake on U.S. Highway 19-21; thence with the eastern boundary line of U.S. Highway 19-21, N. 10 degrees 50 minutes E. 41.38 feet back to the point of beginning, containing 11,564 square feet.

Being the same property conveyed to Richard L. Chambers, Jr. and Doris Ann Chambers by deed dated May 31, 2016, and recorded on June 22, 2016, in Book 5062, at Page 5163, in the office of the Clerk of the Raleigh County Commission.
Parcel 2:
BEGINNING at a steel rebar (found) at the common corner of Richard Chambers, Jr. and Doris Ann Chambers property, which Hazel Marlene Chambers has a lifetime estate, said rebar being on the common line with the Mary Margaret Crew property and S 65o 58′ 00″ E and 313.99 feet from a corner fence post (found); thence, leaving the Crew line and with the Chambers line S 23o 38′ 12″ W for 99.96 feet to a steel rebar (found) on the northern line of a forty foot (40′) roadway easement; thence, with the northern easement line N 66o 45′ 57″ W for 31.43 feet to a steel rebar (set); thence leaving the northern line of the forty foot (40′) roadway easement and passing through the Donna J. O’Neal property N 15o 50′ 29″ E for 101.44 feet to a steel rebar (set) on the Crew line; thence, with the Crew line S 65o 58′ 00″ E and 45.19 feet to the point of beginning and containing 0.088 acres, more or less.

Being the same property conveyed to Richard L. Chambers, Jr., et al., by deed dated December 3, 2003, and recorded on December 17, 2003, in Book 5011, at Page 4741, in the office of the Clerk of the Raleigh County Commission
TERMS OF SALE:
1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.
2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code § 11-22-1.
3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.
4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.
5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.
6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
