Notice is hereby given to William Luke Stepp, Jessica Nicole Stepp, Frontier West Virginia Inc., Unknown Persons/Owners, and Bradley G. Ellison, Sheriff of Wyoming County, West Virginia (hereinafter sometimes referred to as “the aforementioned respondents”), that a Petition for Condemnation/Right of Entry has been filed in the Circuit Court of Wyoming County, West Virginia, and is known as Civil Action No. CC-55-2023-C-42, and styled Appalachian Power Company vs. William Luke Stepp, et al.
Said Petition for Condemnation/Right of Entry under the West Virginia laws of eminent domain seeks property for the construction of electrical transmission, distribution, and communication lines and appurtenant equipment and fixtures, and condemnation and right of entry on behalf of Appalachian Power Company situate on the Clear Fork of Guyandotte River opposite and below the mouth of Crane Fork of Oceana District, Wyoming County, West Virginia, identified as Tax Map 130, Parcel 8, and recorded in the office of the Clerk of the County Commission of Wyoming County, West Virginia, in Deed Book 505, at page 976, and bounded and described as follows:

Containing 90.887 acres, more or less, and being a portion of the property conveyed to Bennie Eugene Stepp and Rebecca Jean Stepp, his wife, by deed dated the 3rd day of October, 1997, of record in the Office of the Clerk of the County Commission of Wyoming County, West Virginia, in Deed Book No. 393, at Page 106.
The aforementioned respondents are hereby notified a copy of said Petition for Condemnation/Right of Entry may be obtained from the Wyoming County Circuit Clerk’s office at the Wyoming County Courthouse, 24 Main Avenue, Pineville, West Virginia, 24874, for the purposes of appearing and defending. The Petition for Condemnation/Right of Entry may also be obtained from the attorneys for Appalachian Power Company, Stephen F. Gandee, Post Office Box 128, 140 West Main Street, Suite 300, Clarksburg, West Virginia, 26302-0128, or Douglas C. McElwee, 700 Virginia Street East, Suite 400, Charleston, West Virginia, 25301.
The aforementioned respondents are further notified that a hearing on the said Petition for Condemnation/Right of Entry will occur on July 25, 2023, at 11:00 a.m., by Teams, by the Circuit Court of Wyoming County, West Virginia, located at the Wyoming County Courthouse, 24 Main Avenue, Pineville, West Virginia, 24874, before the Honorable Micheal M. Cochrane. You may appear and participate for hearing as stated above, and are notified that any failure to appear may result in the waiver of any defenses or claims, if any, you may have. Should you desire to participate, you may obtain the access information for the Teams meeting from the Court’s secretary by calling (304) 732-7047 ahead of time and identifying this case number, hearing date, and time.
