NOTICE OF TRUSTEE’S SALE

In execution of the deed of trust, dated November 14, 2007, from Roxanne B. Bourne and Richard J. Bourne to Stephen M. Feola and Gary R. Mills, as trustees, of record in said Clerk’s Office in Trust Deed Book 1128, at page 175, the undersigned trustee will offer for sale at public auction on July 28, 2023, at 10:00 a.m. at the North Walker Street entrance to the Mercer County Courthouse, Princeton, West Virginia, all that certain tract or parcel of real estate together with the improvements thereon and appurtenances thereunto belonging, situate near Brushfork at Littlesburg, Beaver Pond District, Mercer County, West Virginia, as shown on plat prepared by Shields Engineering, filed of record in the Mercer County Clerk’s Office as Microfilm Plat No 9301, and which property is more particularly bounded and described as follows:

BEGINNING at a 1-inch iron pipe set in the southern line of Glen Steve Bourne, Sr, and Lillian L. Bourne’s 175 acre residence parcel of record in Deed Book 583, at page 402, thence leaving said 175 acre parcel and through the lands of Steve Bourne, Sr, and Richard Bourne the following S 35deg. 52′ 30″ E 288 58 feet to a 1/2-inch iron pipe found, thence S 50deg. 49′ W 273.88 feet to a 1/2-inch iron pipe found, thence N 33deg. 47′ 30″ W 338 09 feet to a 1/2-inch iron pipe set, thence N 05deg. 11′ W 201 64 feet to a 1-inch iron pipe set, thence N 45deg. 32′ E 79 73 feet to a 1-inch steel rod set with the western line of the aforementioned 175 acre parcel, thence with the western and southern lines of said 175 acre parcel the following S 29deg. 38′ E 93 52 feet to a 1/2-inch iron pipe set, thence N 75deg. 20′ E 22 78 feet to a called and found corner fence post, thence S 14deg. 45′ E 84 91 feet to a called and found 3/4-inch iron pipe, thence N 75deg. 20′ E 106 08 feet to the point of BEGINNING, and containing 2.50 acres

And being the same real estate conveyed unto the Grantors herein by deed of Maxine S. Bourne, et al, dated June 30, 1986, of record in the said Clerk’s Office in Deed Book 657, at page 230

Grantors further grant and convey unto Trustee that certain right-of-way for a driveway providing access to the hereinabove described real estate from State Route 23, together with all rights and restrictions pertaining to the use thereof

The deed of trust states that the address of the real estate is RR 1 Box 465-A, Bluefield, West Virginia.

J. Peter Richardson was appointed substitute trustee by the APPOINTMENT OF SUBSTITUTE TRUSTEE, dated June 19, 2023, of record in said Clerk’s Office in Trust Deed Book 1459, at page 39.

This sale will include all rights, easements, appurtenances, improvements and structures that are part of the real estate described above. This sale will be subject to all restrictions, rights-of-way, conditions, easements and matters of record, mechanics’ and materialmen’s liens, if any, whether of record or not of record, and unpaid real estate taxes, to the extent any of the foregoing apply and take priority over the lien of the deed of trust.

TERMS OF SALE: Cash in hand on day of sale. The conveyance of the real estate will be by a deed without any covenant or warranty, express or implied. The real estate and any improvements thereon will be sold in “as is” condition without any warranties. The successful bidder will assume the risk of all loss or damage to the real estate and any improvements thereon after the sale, and be responsible for all costs of the conveyance including, but not limited to, any examination of title, preparation of the deed, excise tax and recording fees. Any announcements made at the sale, including postponement of the sale and withdrawal of the real estate from sale, will take priority over published notices.
