NOTICE OF SUBSTITUTE TRUSTEES’ FORECLOSURE SALE OF VALUABLE
RESIDENTIAL REAL ESTATE

Upon notification by the holder of a Note secured by the Deed of Trust described below of a default and having been requested to institute these proceedings, and by the virtue of the authority vested in us under that certain Deed of Trust dated the 15th day of October, 2019, executed by James A. Mays unto Thomas S. Lilly and Phillip B. Ball, as Trustees, which said Deed of Trust is of record in the Office of the Clerk of the County Commission of Mercer County, West Virginia, in Trust Deed Book 1380, at Page 465, which said Deed of Trust secured Terry Allen Parks and Jessica Lynn Parks, in the principal sum of $18,500.00. By Substitution of Trustees dated June 22, 2023, Phillip B. Ball and Gregory K. Ball were substituted as trustees for the said Thomas S. Lilly and Phillip B. Ball, which is of record in said Clerk’s Office in Book 1458, at Page 797, we will

ON THE 16TH DAY OF AUGUST, 2023, AT 10:00 O’CLOCK A.M., at the front door of the Mercer County Court House (being the North Walker Street side) at Princeton, Mercer County, West Virginia, offer for sale at public auction to the highest bidder, the following residential property, to-wit:

“Lot 128 on “PLAT SHOWING DIVISION AND LOT LAYOUT OF THE TERRY PARKS FARM LYING ON THE WATERS OF BRUSHFORK CREEK OF BLUESTONE RIVER, BEAVER POND DISTRICT, MERCER COUNTY, SITUATE SOUTHWEST OF THE COMMUNITY OF LITTLESBURG, WEST VIRGINIA, SCALE 1″= 100′ JUNE 12, 2017, said plat is of record in the Office of the Clerk of the County Commission of Mercer County, West Virginia as Microfilm Plat # 17656, and move fully bounded and described as follows: BEGINNING at a point on the eastern line of a 40-foot wide street, now known as Captain’s Street at the western terminus of the division line between Lots 126 and 128: thence, with the eastern line of Captain’s Street, N. 10 43′ 05″ W, 150.00 feet to a point; thence, with the division line between Lot 130 and Lot 128, N. 79 16′ 45″ E, 150.00 feet to a point; thence, S. 10 43′ 15″ E, 150.00 feet to a point; thence, with the division line between Lots 126 and Lot 128, S. 79 16′ 45″ W, 150.00 feet to the place of the BEGINNING, and containing 0.52 acres, more or less.”

“This Deed is made subject to a Declaration of Protective Covenants, Reservations and Restrictions, recorded in said Clerk’s Office, in Deed Book 1081, at Page 307.”

The terms of the sale shall be cash in hand on the day of the sale (or such other arrangement as may be satifactory to Trustee and holder of the Note) and said property is being sold in “as is” condition. Said sale is subject to all taxes now due or to become due on said property, all liens, including but not limited to sewer liens and restrictions, easements or other matters of record in said Clerk’s Office affecting the title to said property. The purchaser is to pay the excise tax on the privilege of transferring said real estate.

In event there are federal tax liens against the property, the United States would have the right to redeem the property wihin a period within a period of 120 days from date of such sale, or the period allowable for redemption under local law, whichever is longer.

Notice is also given that any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.
