NOTICE OF TRUSTEE’S SALE

Under authority of that certain Deed of Trust dated July 27, 2018, from Susan Michelle Sparks to Marc B. Lazenby, Trustee, of record in the office of the Clerk of the County Commission of McDowell County, West Virginia in Trust Deed Book No. 444, at page 499, securing a promissory note in the principal amount of $59,713.51, payable to Vanderbilt Mortgage and Finance, Inc., and default having been made under the promissory note secured by the aforesaid Deed of Trust and sale requested by Vanderbilt Mortgage and Finance, Inc., the undersigned Trustee will offer for sale at the front door of the McDowell County Courthouse in Welch, West Virginia, on August 24, 2023 at 10:30 a.m., subject to all reservations, exceptions, easements and other matters which appear of record, and subject to all unpaid taxes, if any, all that certain lot, tract and parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, as follows:

Situate in the State of West Virginia, in McDowell County, and located on the North and East sides of State Route 16, between the communities of Newhall and Squire, being a cut-out from the lands of Walter R. Davis and Dolly Sue Davis, and being more particularly described as follows:

Beginning at an iron pin set in the East right of way of State Route 16, being a common corner with the land depicted on Tax Map 410, Parcel 14, thence leaving said right of way and with a common line between said parcels N 50deg. 12′ 30″ E 317.450 feet to a t-rail called for and found; thence continuing with the said common lines S 39deg. 45′ 30″ E 161.120 feet to a t-rail called for and found; thence cutting through the property of Davis on a new line S 57deg. 01′ 36″ W 300.203 feet to an iron pin set in the eastern right of way of State Route 16; thence with the eastern right of way of State Route 16 on a curve to the left, having a radius of 447.986 feet, an arc length of 127.380 feet and a chord bearing and distance of N 48deg. 31′ 31″ W 126.951 feet to the point of beginning, containing 1.00 acres more or less and being a part of the land standing in the name of Walter R. Davis and Dollie Sue Davis as per Deed Book 481, Page 401, dated the 1st day of November, 2002 and identified as parcel 60 on Tax Map 29 and of record in the Clerk’s Office of McDowell County, West Virginia.

Serving a newly created 1.0 acre parcel situate in the State of West Virginia, in McDowell County, and located on the North and East sides of State Route 16, between the communities of Newhall and Squire, being a cut-out from the lands of Walter R. Davis and Dolly Sue Davis, and said right of way being more particularly described as follows:

Beginning at a point in the centerline of the existing driveway and eastern edge of State Route 16, said driveway currently accessing the subject tract, thence along the centerline of said existing driveway N 23deg. 08′ 23″ E 42.791 feet to a point; thence continuing along said centerline N 10deg. 44′ 47″ E 22.795 feet (crossing said eastern R/W line of State Route 16 at 17.977 feet) to a point; thence N 01deg. 22′ 23″ W 58.662 feet to a point; thence N 03deg. 38′ 30″ W 10.848 feet to a point; thence N 10deg. 22′ 08″ W 22.121 feet to a point; thence N 24deg. 36′ 35″ W 38.872 feet to a point; thence N 32deg. 26′ 16″ W 39.479 feet to a point; thence N 43deg. 25′ 55″ W 11.838 feet to a point in the newly created southern line of the 1.0 acre tract, said right of way to be along the existing driveway as it now exists.

Together with a certain 2016 CMH Mobile Home, Serial No. CLM099980TN.

Being the same property conveyed from Dolly Sue Davis to Susan Michelle Sparks by Deed dated July 27, 2018, of record in the aforesaid Clerk’s office in Deed Book No. 607, at page 486.
