LEGAL NOTICE
REQUEST FOR PROPOSALS FOR ACCOUNTANT,
PROJECT ATTORNEY,
APPRAISER, REVIEW
APPRAISER, RIGHT-OF-WAY
NEGOTIATOR, BOND COUNSEL

The Town of Davy, McDowell County, West Virginia is in the process of obtaining professional services necessary to complete a water project for the Town of Davy, including, but not limited to, the construction of a new water treatment plant, demolition of the existing water treatment plant, water transmission and distribution improvements, installation of new waterlines and fire hydrants, relocation of the Asco booster pump station, and upgrades to infrastructure components. These services include appraiser, review appraiser, right-of-way negotiator, accountant, project attorney, and bond counsel. The selected professionals will work closely with all members of the project team, including the Town of Davy and Region I Planning & Development Council.

The selected accountant will provide accounting services to prepare Rule 42 Exhibit to accompany the IJDC application as well as the application for Certificate of Convenience and Necessity to the West Virginia Public Service Commission, in addition to any other services needed in relation to the project.

The project attorney is an integrate part of the project team and will provide general legal services as necessary during the development and construction of the project. Areas of practice include obtaining a Certificate of Convenience from the West Virginia Public Service Commission, title work as necessary to obtain construction rights-of-way and parcels, and review of all contracts and related documents as necessary.

The selected appraiser, review appraiser, and right-of-way negotiator will work closely with the project attorney and engineer to obtain all necessary rights-of-way and parcels.

The selected bond counsel is an integrate part of the project team and will work closely with the project team to complete all necessary services in relation to the project.

Procurement of the said services shall be in accordance with 2 CFR 200.320 (b)(2). Contracts are to be awarded on familiarity with and expertise on this type of project, as well as on a fixed basis for services. All those interested in being considered for this must submit a proposal detailing qualifications and staffing capabilities, related prior work experience, fee schedule, and ability to complete work as needed on this project in a timely manner.

Contracts will be awarded to the responsible offeror whose proposal is within the competitive range and determined to be the most advantageous to the project; price and other factors considered including familiarity and expertise with this type of project. The consultant’s eligibility to receive federal funds will be verified at http://www.sam.gov prior to contract award.

If interested in providing these services, please submit an original, three (3) copies, and a digital submission of all requested information to the Town of Davy, and one (1) copy and a digital submission to Region I Planning & Development Council by 4:00 p.m. on Friday, August 18, 2023.

Attention is directed to the fact that the proposed project may be undertaken through funding sources including, but not limited to the HUD/Community Development Block Grant, Appalachian Regional Commission (ARC), the Economic Development Administration (EDA), the West Virginia Department of Environmental Protection (WV DEP), USDA-RD, the West Virginia Infrastructure and Jobs Development Council, and the State Revolving Loan Fund.

All work will be performed in accordance with the regulations issued by HUD/Community Development Block Grant, Appalachian Regional Commission (ARC), the Economic Development Administration (EDA), the West Virginia Department of Environmental Protection (WV DEP), USDA-RD, the West Virginia Infrastructure and Jobs Development Council, the State Revolving Loan Fund, and the State of West Virginia appertaining thereto. The selected firm(s) will be required to comply with Executive Order 11246, Section 3 of the Housing and Urban Development Act of 1974, Conflict of Interest Statement and Access of Records, Title VI and Section 109.

The Town of Davy will afford full opportunity for minority business enterprises to submit a show of interest in response to this invitation and will not discriminate against any interested firm or individual on the grounds of race, color, creed, sex, age, handicap or national origin in the contract award.

The Town of Davy reserves the right to accept or reject any and/or all proposals. The Town of Davy also reserves the right to negotiate the fee for services.
