TRUSTEE’S SALE OF
VALUABLE REAL ESTATE

The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated February 28, 2018, and duly recorded in the Office of the Clerk of the County Commission of Mercer County, West Virginia, in Deed of Trust Book 1351, at Page 75, Chad Femmino and Tess Femmino did convey unto Douglas Hayes, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Mercer County Courthouse, in Princeton, West Virginia, on

August 17, 2023 at 1:50 PM

The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Beaver Pond District, Mercer County, West Virginia, and more particularly described as follows:

“All of that certain tract or parcel of land situate and being on the waters of Brush Creek, in Beaver Pond District, Mercer County, West Virginia, bounded and described as follows:

‘BEGINNING at a stake on the Northeast bank of the upper Roadway and corner of the property of John R. Smith and Louise Smith; thence with the Northeast bank of said Roadway, N. 25deg. 10′ W. 45.5 feet, N. 19deg. 30′ W. 46 feet, N. 27deg. W. 84.5 feet, N. 7deg. W. 112.25 feet, N. 3deg. 30′ E. 114.6 feet, N. 15deg. 10′ W. 53.5 feet, N. 16deg. 10′ E. to a stake on the Northeast bank of said Roadway; thence over and across the property of the said parties of the first part, S. 85deg. E. 368.7 feet to a stake in the line of Della Smith; thence with line of said Della Smith, S. 12deg. E. 312.6 feet to a stake and corner of said John R. Smith and Louise Smith; thence with their line, S. 58deg. 20’ W. 437.5 feet to the BEGINNING, containing 4.2 acres. more or less.'”

At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 2971 Harmon School Road, Princeton, WV 24739.

AND BEING the same real estate which was conveyed to Chad R. Femmino and Tess Femmino by Deed dated February 28, 2018, from Garland E. Ragan and Lillian Ragan, and recorded in the Office of the Clerk of the County Commission of Mercer County, West Virginia, in Deed Book 1063, at Page 663.
The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: Ten percent (10%) of the purchase price as a deposit with the balance due and payable within 30 days of the day of sale.
