Upon notification by United Bank, a Virginia corporation, successor by merger to United Bank Inc., the holder of a Note secured by a Deed of Trust dated February 1, 2013, executed by Theodore Werblin and Sara Werblin, unto P. Michael Pleska & F. Thomas Graff, Jr., as Trustees, recorded in the Office of the Clerk of the County Commission of Mercer County, West Virginia in Trust Deed Book 1249, at Page 465, of a default, and having been requested to institute these proceedings, and by virtue of the authority vested in us by Substitution of Trustees, dated July 5, 2023, recorded in said Clerk’s Office in Registration and Substitution of Trustee Book 1459, at Page 579, by which we were substituted as trustees for the said P. Michael Pleska & F. Thomas Graff, Jr., we will

ON THE 1ST DAY OF SEPTEMBER, 2023, AT 10:00 O’CLOCK A.M., at the front door of Mercer County Courthouse at Princeton, West Virginia, offer for sale at public auction to the highest bidder, the following property, to-wit:

“those certain lots or parcels of real estate situate in the City of Bluefield, Mercer County, West Virginia, being all of Lots 1 and 10 and the western parts of Lots 2 and 11, Section 951, a small strip off the western side of Lot 12, Section 951, a portion of an abandoned alley and the southern part of the eastern part of Lot 2, Section 951, all as shown upon a map thereof prepared by Appalachian Engineering & Surveying, inc., dated 1/11/85 and revised 8/12/87, duly recorded as Microplat No. 9641, and all of said parcels of real estate together being more particularly bounded and described as follows:

“BEGINNING at a point in the intersection of the eastern right-of-way line of Bland Road with the southern right-of-way line of Oakhurst Avenue, said point to also being the northwest corner of Lot 1, Section 951; thence leaving Bland Road and with the southern right-of-way line of Oakhurst Avenue, N. 56o 00′ E. 99.15 feet to a point in the northern line of the western pary of Lot 2; thence continuing along the northern line of the western part If Lot 2, N. 53o 49′ E. 26.62 feet to a point; thence, leaving Oakhurst Avenue and through Lot 2, Section 951, S. 28o 30′ E. 153.44 feet to a roof bolt; thence through the eastern part of Lot 2, N. 60o 03′ E 41.47 feet to a roofbolt in the western line of a 15 feet wide alley now closed and abandoned; thence N. 66o 49′ E. 7.53 feet to a roof bolt in the center of the intersection of said 15 foot wide alley and another 15 feet wide alley now closed and abandoned running in a north-south direction; thence with the center line of the second 15 feet wide alley S. 28o 30′ E. 18.68 feet to a point located S. 60o 03′ W. 0.90 feet from an existing roof bolt; thence N. 60o 03′ E. 0.90 feet to said roof bolt at the base of a concrete wall, S. 28o 25′ E. 33.26 feet to a roof bolt; thence leaving said concrete wall, S. 61o 30′ W. 28.59 feet to an iron bar; thence continuing through Lot 11, Section 951, S. 28o 28′ E. 143.08 feet to an iron bar in the northern right-of-way line of Bland Road; thence along and with the northern right-of-way line of Bland Road, S. 66o 49′ W. 101.3 feet to a point; thence with a curve to the right with a radius of 50 feet 73.83 feet to a point; thence continuing along and with the eastern right-of-way line of Bland Road, N. 28o 30′ W. 280.71 feet to the point of BEGINNING, and containing 47,731 square feet or 1.09 acres, more or less.”

The terms of the sale shall be cash in hand on the day of sale (or such other arrangement as may be satisfactory to said Substitute Trustees and holder of the Note), and said property is being sold in “as is” condition. Said sale is subject to all taxes now due or to become due on said property, all liens, including but not limited to, sewer liens and restrictions, easements or other matters of record in said Clerk’s Office, affecting the title to said property. The purchaser is to pay the excise tax on the privelege of transferringsaid real estate.

In the event there are federal tax liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale, or the period allowable for redemption under local law, whichever is longer.

Notice is also given that any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.
