PROTECTIVE ORDER

This Court finds that: (Initial and Complete as applicable)

J.P. Respondent has not been served with the Emergency Domestic Violence Protective Order by law enforcement.

J.P. It is therefore ORDERED that the hearing in this matter is continued and shall be held on the 9th day of August, 2023 at 1:30 p.m., to take place in the Family Court of Kanawha County, West Virginia.

J.P. It is FURTHER ORDERED that the Emergency Protective Order issued previously on the 24th day of July, 2023, is continued in full force and effect until the hearing on the Petition is held and an Order is issued by the Family Court.

Any and all provisions of the Emergency Protective Order, not specifically modified herein shall remain in full force and effect until the hearing on the Petition is held and an Order is issued by the Family Court.

J.P. It is FURTHER ORDERED that law-enforcement shall serve this Order, the Petition, and the Domestic Violence Emergency Protective Order on the Respondent, forthwith, at the following address:

J.P. It is FURTHER ORDERED that the Circuit Clerk shall serve this Order by publication in accordance with Rule 11 of the Rules of Practice and Procedure for Domestic Violence Proceedings, forthwith.

It is FURTHER ORDERED that a copy of this Order shall be served by law-enforcement upon the parties. The Circuit Clerk shall transmit a copy of this Order immediately, but no later than the next business day to any law-enforcement agency having jurisdiction to enforce this Order, including the county sheriff, the local office of state police, and any municipal police force, to be placed in a confidential file by such law-enforcement agencies pursuant to W.Va. Code § 48-27-403 and subject to W.Va. Code § 48-28-601. The Circuit Clerk shall immediately , by hand delivery or facsimile, deliver this Order to Magistrate Court. Magistrate Court shall immediately electronically enter the Order for inclusion in the National Domestic Violence Registry and the Family Court shall electronically enter the Order for inclusion in the WV Domestic Violence State Database immediately upon issuance.
