CASE NO. 23-0112-W-DU

HUTCHINSON COMMUNITY
WATER ASSOCIATION,
Petition for Determination that Hutchinson Community Water Association is a Distressed or Failing Utility Under W. Va. Code §24-2H-6(a).

NOTICE OF HEARING

On February 10, 2023, William Tobrey, on behalf of the Hutchinson Community Water Association filed a petition for determination that the Association, operating as a utility, is a distressed or failing utility under W. Va. Code §24-2H-1, et seq. With the exception of Mr. Tobrey, all of the Association’s board members resigned from their positions, and the Association no longer wishes to operate as a water utility. Commission Staff subsequently recommended the Commission determine that the Association is a failing utility and order its transfer to a capable proximate utility (The City of Shinnston, The City of Fairmont, The Clarksburg Water Board, Bingamon Public Service District, Sun Valley Public Service District, and Shortline Public Service District).

This matter has been scheduled for public comment and an evidentiary hearing on August 14, 2023, at 11:00 a.m., at the Bridgeport City Hall, Council Chambers, 515 West
Main Street, Bridgeport, West Virginia.

The public hearing shall be conducted to receive comment from interested individuals, including comment regarding options available to bring the distressed or failing utility into compliance with appropriate statutory and regulatory standards. At the evidentiary hearing, the Commission shall receive evidence to determine (i) if the utility is a failing utility, (ii) whether a capable proximate utility should acquire or manage the Association or (iii) if there is a reasonable alternative disposition.
