Activity:
To operate and maintain an existing combined wastewater collection system. These facilities are to serve a population equivalent of approximately 1,200 persons in the Town of Barrackville, and environs, and convey wastewater to the City of Fairmont’s wastewater collection system and wastewater treatment plant for ultimate treatment. To operate and maintain disposal systems, best management practices, and the nine (9) minimum controls for the direct discharge of sanitary wastewater and storm water from Combined Sewer Overflow (CSO) Outlet Nos. C004, C011, C012 and C013 to Buffalo Creek of the Monongahela River during wet weather flow events. These CSO outlets are permitted to discharge only when the hydraulic capacity of the collection system is exceeded during wet weather events. Also to approve a revised Long-term Control Plan. An antidegradation review has been conducted. Tier 1 protection has been afforded for the uses specified in Title 47, Series 2 for the combined sewer overflow outlets through implementation of the facility’s Long-term Control Plan.

Compliance with the Combined Sewer Overflow requirements shall be attained in accordance with the provisions of Administrative Order No. 6506, issued the 11th day of September 2008, Amendment No. 1, issued the 12th day of July 2012, Amendment No. 2, issued the 16th day of July 2018, and Amendment No. 3, issued the 12th day of March 2019.

On the basis of review of the application, the “Water Pollution Control Act (Chapter 22, Article 11-8(a)),” and the “West Virginia Legislative Rules,” the State of West Virginia will act on the above application.

Any interested person may submit written comments on the draft permit and may request a public hearing by addressing such to the Director of the Division of Water and Waste Management within 30 days of the date of the public notice. Such comments or requests should be addressed to:

The public comment period begins August 23, 2023 and ends September 22, 2023.

Comments received within this period will be considered prior to acting on the permit application. Correspondence should include the name, address and the telephone number of the writer and a concise statement of the nature of the issues raised. The Director shall hold a public hearing whenever a finding is made, on the basis of requests, that there is a significant degree of public interest on issues relevant to the Draft Permit(s). Interested persons may contact the public information office to obtain further information.
