NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS

These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by the Rupert School LP

REQUEST FOR RELEASE OF FUNDS

On or about 9/26/23 the Greenbrier County Commission will authorize the Rupert School LP. to submit a request to Housing and Urban Development for the release of PBV funds under Section 8(o)(13) of the United States Housing Act of 1937, 42 U.S.C. 1473f(o)(13), as amended by section 232 of the Fiscal Year 2001, to undertake a project known as The Rupert School Project for the purpose of rehabilitating the Rupert School building, located at 279 Church St. Rupert, WV 25984. Rehabilitation will include the development of 14 residential units and a healthcare clinic. This work will included 100% new electrical, hvac, and plumbing, as well as a new sprinkler system, elevator, the replacement of exterior windows, a new roof, a new parking lot and sidewalks, as well as new interior finishes. Work is expected to begin on or around 10/16/23. The total project is expected to cost approximately $4,758,883, with approximately $854,985 of HUD funds, which will provide rental assistance to the project’s future residential tenants.

FINDING OF NO SIGNIFICANT IMPACT

The Greenbrier County Commission has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at 912 Court St. N, Lewisburg, WV 24901 and may be examined or copied weekdays 8:30 A.M to 4:30 P.M.

PUBLIC COMMENTS

Any individual, group, or agency may submit written comments on the ERR to the Greenbrier County Commission. All comments received by 9/25/23 will be considered by the Greenbrier County Commission prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing.

ENVIRONMENTAL CERTIFICATION

The Greenbrier County Commission certifies to Housing and Urban Development that Tammy Tincher in their capacity as President of the Greenbrier County Commission consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the Rupert School LP. to use Program funds.

OBJECTIONS TO RELEASE OF FUNDS

HUD will accept objections to its release of fund and the Greenbrier County Commission’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the Greenbrier County Commission (b) the Greenbrier County Commission has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to HUD office of Public and Indian Housing (PIH) Division at Bank of America Building, Tower II 100 South Charles Street, 5th Floor Baltimore, MD 21201 Potential objectors should contact HUD to verify the actual last day of the objection period.
