In execution of the Deed of Trust in the original principal amount of $112,433.00 dated June 4, 2015 and recorded in Book 2015, Page 08395, as Instrument No. 150001650, of the Tazewell County land records, the appointed Substitute Trustee will offer for sale at public auction at main entrance of the Circuit Court for Tazewell County located at, 135 Court Street, Tazewell, Virginia 24651 on November 21, 2023 at 12:30 PM, the property described in said deed of trust, located at the above address and more particularly described as follows::

The land referred to herein below is situated in the County of Tazewell, State of Virginia in Deed Book 1117 at Page 1014 and is described as follows:

All those two certain lots or parcels of land situate in Town of Tazewell, Tazewell County, Virginia, on the South side of and fronting Tazewell Avenue, and being Lots Numbered Five (5) and Six (6) as the same are shown on that certain Plat entitled “Tazewell an addition to the Town of Jeffersonville, Tazewell Co. VA. Property of the Tazewell Courthouse Improvement Co.” which Plat is dated November 18, 1890, and is found of record in the Clerk’s Office of The Circuit Court of Tazewell County, Virginia, in Deed Book 30, at Page 12 and 13, reference to which plat is hereby made for a more particularly description of the lots conveyed herein.

Subject to and beneficiary of any and all easements, restrictions, and reservations contained in duly recorded deeds, plats, and other instruments constituting constructive notice in the chain of title, which have not expired by a time limitation contained therein or have otherwise become ineffective, and to matters visible upon inspection. Being the same property described in the Deed to John W. Ward from The Estate of Loretta A. Sill, Administratrix and Gini Remines, Individually, recorded on August 10, 2012 in Deed Book 1117, at Page 1014, of the Public Records of Tazewell County, Virginia.

Commonly known as 207 Tazewell Ave, Tazewell, VA 24651. However, by showing this address no additional coverage is provided.

The property and improvements will be sold in “as is” physical condition without warranty of any kind.

TERMS OF SALE: A non-refundable bidder’s deposit of 10% of the sale price or 10% of the original principal amount of the subject Deed of Trust, whichever is lower, by cashier’s or certified check, required at time of sale except for the party secured by the Deed of Trust. Risk of loss on purchaser from date and time of auction. Balance of the purchase price must be paid by cashier’s check within 15 days from sale date. Except for Virginia Grantor’s tax, all settlement costs and expenses are purchaser’s responsibility. Taxes are pro-rated to the date of sale. Purchaser is responsible for obtaining possession of the property. If purchaser defaults, deposit may be forfeited and property resold at the risk and cost of the defaulting purchaser who shall be liable for any deficiency in the purchase price and all costs, expenses and attorney’s fees of both sales. If Trustee does not convey title for any reason, purchaser’s sole remedy is return of deposit without interest. This sale is subject to post-sale audit by the Substitute Trustee of the conduct of the auction itself as well as the status of the loan secured by the Deed of Trust, including, but not limited to, determining whether prior to sale a bankruptcy was filed, a forbearance, repayment or other agreement was entered into or the loan was reinstated or paid off; in any such event this sale shall be null and void and purchaser’s sole remedy shall be return of deposit without interest.
