NOTICE
Sealed bids for the Telecommunication Tower Site BB11 (Contract A & Contract B) will be received by the Upshur County Development Authority, 21 East Main Street, Suite 101, Buckhannon, West Virginia 26201, until 2:00 P.M., L.P.T., on October 25, 2023, for furnishing labor and materials and performing all work set forth in the Advertisement for Bids, Information for Bidders, Bid and Bid Schedule (Form of Proposal and Unit Price Bid Form), General Conditions, Supplementary Conditions, AML Provisions, Specification Special Conditions, Technical Specifications and Plans (Drawings) prepared by Potesta & Associates, Inc., and all addenda issued prior to receipt of Bids. Immediately following the scheduled closing time for the reception of bids, all proposals which have been submitted in accordance with the conditions of this project will be publicly opened and read aloud.
The Work to be bid upon is generally described as follows:
Contract A
— Designing/analyzing, furnishing, delivering, and unloading of the self-support telecommunications tower and associated equipment/appurtenances. Design/analysis to be sealed by a Professional Engineer licensed in the State of West Virginia.
— The tower structure shall be 295 feet tall, not including antennae.
— The site is located in Greenbrier County, near the Town of Quinwood.
— Construction time limit for the Contract is 120 consecutive calendar days to include design, delivery and offloading of the tower at the site.
— Liquidated damages may be assessed in accordance with Article 3 of the Agreement.
Contract B
— Site preparation, earthwork, and construction of tower site including access road, gravel pad, and erecting/installing the self-support telecommunication tower and associated equipment/appurtenances. — The site is located in Greenbrier County, near the Town of Quinwood.
— Construction time limit for the Contract is 180 consecutive calendar days to substantial completion for Base Bid work which includes erecting and providing a fully functional tower at the site location. The Contractor selected for Contract B should be aware that the timeframe associated with Contract A is 120 days which includes delivery of the tower to the site.
— Liquidated damages may be assessed in accordance with Article 3 of the Agreement.
Bids shall be on a unit price basis. Contracts shall be awarded separately. Bidders are permitted to bid on a single contract or both contracts. The two-envelope system will be used for bidding each Contract A (2) and Contract B (2) for a potential total of four envelopes. Call the Accounting Department at (304) 342-1400 to purchase Bidding Documents. Bidding Documents will be released upon payment of $50 for an electronic set and $200 for each hard-copy set of documents. All checks shall be made payable to Potesta & Associates, Inc. Prospective bidders may obtain previously ordered Bidding Documents by appointment at the issuing office Monday through Friday between the hours of 10:00 a.m. and 4:00 p.m. Cost does not include shipping charges. A mandatory Pre-Bid Conference will be held on October 11, 2023 at 11:00 A.M. Please meet at the Coal Miner’s Memorial on Route 20 in Quinwood, near the intersection of Route 2. A visit of the site will follow the Pre-Bid Conference. Prospective bidders may not visit the site or enter onto the project properties unaccompanied by the Owner. A bidder may not withdraw his bid for a period of sixty (60) days after the date set for the opening of bids. Bids shall be accompanied by a certified check or bid bond payable to Upshur County Development Authority in an amount not less than five percent (5%) of the base bid. All bids shall also be accompanied by an executed Drug Free Workplace Certification, and a valid WV Contractors License. Bids received after the scheduled closing time for the reception of bids will be returned unopened to the bidders. Upshur County Development Authority reserves the right to reject any and/or all bids. Prospective Bidders are advised that the contract awarded under this bid is to be funded in whole or in part by the Upshur County Development Authority and West Virginia Department of Environmental Protection – Abandoned Mine Lands. Bidders must comply with the President’s Executive Order Nos. 11246 and 11375, which prohibit discrimination in employment regarding race, creed, color, sex, or national origin. Bidders must comply with Title VI of the Civil Rights Act of 1964, the Anti-Kickback Act, Section 3 Segregated Facilities, Section 109, the Contract Work Hours Standard Act and the “Buy American Act,” which will be discussed at the Pre-Bid and in the addendum. Bidders must certify that they do not and will not maintain or provide for their employees any facilities that are segregated on the basis of race, color, creed or national origin. Federal Law prohibits discrimination on the grounds of race, color, national origin, religion, age, handicap, and sex in this project. Minority firms are particularly encouraged to participate. USE OF MINORITY, WOMEN’S AND SMALL BUSINESS ENTERPRISES Should the Contractor intend to sublet a portion of the work on this project, it shall seek out and consider minority, women, and small business enterprises as potential subcontractors. The Contractor shall contact minority, women’s, and small businesses to solicit their interest, capability, and prices, and shall retain proper documentation to substantiate such contacts. The Contractor will sign and provide the Minority, Women’s, and Small Business Affirmative Action Certification to DEP along with the name(s) of any subcontractor(s) it submits for approval.
