THE OBJECT OF THE ABOVE-
ENTITLED ACTION IS THE ENFORCEMENT OF PLAINTIFF’S LIEN AGAINST CERTAIN REAL PROPERTY OWNED BY DEFENDANT LOCATED IN THE CITY OF MONTGOMERY.
It appearing affidavit that Defendant is a nonresident of the state for whom no agent, or appointed or statutory agent or attorney in fact is found in the state upon whom service may be had.
It appearing by affidavit there may be persons other than those named in the complaint as plaintiff and defendant that are interested in the subjection matter of the action, whose names are unknown to the plaintiff.
Accordingly, it is ordered that KARTIAS KLASSICO AND ANY OTHER PERSONS HAVING AN INTEREST IN THE FORMER MONTGOMERY CITY HALL PROPERTY DESCRIBED AS “LOT INTERSECTION 3RD & 4TH AVE” IN MONTGOMERY, WEST VIRGINIA, AND BEING THE SAME REAL PROPERTY RECORDED NOVEMBER 19, 2020, IN THE FAYETTE COUNTY CLERK’S OFFICE IN DEED BOOK 806, AT PAGE 490 do serve upon John F. Gianola, Esq., Petitioner’s Attorney, whose address is 300 Summers Street, Suite 700, Charleston, West Virginia, 25301. an Answer including any related counterclaim or defense they may have to the Petition filed in this action on or before October 23, 2023. If you fail to do so, judgment by default will be taken against your interests at any time thereafter.
A copy of the Petition may be obtained from the Office of the Circuit Clerk of Fayette County or Plaintiff’s counsel listed above.
