NOTICE OF PUBLIC HEARING
ON PROPOSED ORDINANCE

TO: CITIZENS OF THE CITY OF FAIRMONT

The Council for the City of Fairmont at its regular meeting held on October 24, 2023, introduced and publicly read, by the entirety or by synopsis, for the first time and set for public hearing a proposed ordinance as follows:

AN ORDINANCE OF THE COUNCIL FOR THE CITY OF FAIRMONT AUTHORIZING THE ACQUISITION OF CERTAIN REAL ESTATE PURSUANT TO THE PROVISIONS OF CHAPTER 54 OF THE WEST VIRGINIA CODE FOR PUBLIC PARKS AND RECREATIONAL FACILITIES, BEING A PART OF THE WEST FAIRMONT RAIL-TRAIL SYSTEM, WHICH REAL ESTATE IS DESCRIBED AS 2.41 AC 12TH ST EXTENSION, BEING PARCEL 0074 0005 OF MARION COUNTY TAX MAP 03-07, AND BEING THE SAME REAL ESTATE ACQUIRED BY NATERNICOLA’S MASONRY, LLC, BY DEED FROM G. RUSSELL ROLLYSON, JR., DEPUTY COMMISSIONER OF DELINQUENT AND NONENTERED LANDS OF MARION COUNTY, WEST VIRGINIA, WHICH DEED IS DATED APRIL 17, 2011, AND OF RECORD IN THE OFFICE OF THE CLERK OF THE COUNTY COMMISSION OF MARION COUNTY, WEST VIRGINIA, IN DEED BOOK 1086, AT PAGE 136, AND AUTHORIZING AND EMPOWERING THE CITY MANAGER TO DO ALL THINGS REASONABLE AND NECESSARY IN CONNECTION THEREWITH.

This ordinance approves the acquisition of certain real estate pursuant to the provisions of Chapter 54 of the West Virginia Code from Naternicola’s Masonry, LLC, in furtherance of the West Fairmont Rail Trail, and which real estate is identified in the ordinance title.

This ordinance provides that the cost of acquisition/market value of the real estate/just compensation has been determined by a certified general real estate appraiser to be $155,000.00.

No revenue bonds or other financing is involved. The acquisition is in furtherance of an approved project that lies within City of Fairmont Redevelopment District No. 1” (the “TIF District”), and is funded as a “pay as you go” project.

The Public Hearing on the proposed Ordinance will be held on Tuesday, November 14, 2023 at 7: 00 p.m., or as soon thereafter as the matter may be heard, in Council Chambers, at the City of Fairmont Public Safety Building, 500 Quincy Street, Fairmont, Marion County, West Virginia.

At which time and place all parties and interests may appear before Council and may be heard as to whether or not said ordinance shall be put into effect. At such hearing all objections and suggestions shall be heard and following said hearing Council shall take such action as it shall deem proper in the premises.

A copy of the proposed Ordinance is on file for review by interested persons during regular business hours (M-F 8:30 a.m. to 4:30 p.m.) in the office of the City Clerk, Room 312, 200 Jackson Street, Fairmont, West Virginia.

NOTICE TO BIDDERS

The Common Council for the City of Beckley is accepting bids from qualified firms for the purchase of 2 extended cab 4-wheel drive trucks.

Complete specifications and bid information may be obtained from the Recorder/Treasurer, at Beckley City Hall, or by calling 304-256-1768 between the hours of 8:30 a.m. to 4:00 p.m., Monday through Friday.

Bids will be received until 4:00 p.m. on Tuesday, November 14, 2023. They will be publicly opened and read aloud during a meeting of Common Council at 6:30 p.m. that same day. Bids must be submitted to the Recorder-Treasurer in sealed envelopes clearly marked to indicate contents. Bids may be hand delivered to 409 South Kanawha Street, or mailed P.O. Box 2514, Beckley, WV 25802-2514. Any bids that arrive after the specified date and time will not be considered.

The City of Beckley reserves the right to accept or reject any or all bids or any part of any bid without cause.
