NOTICE OF PUBLIC HEARING
ON PROPOSED ORDINANCE

TO: CITIZENS OF THE CITY OF FAIRMONT

The Council for the City of Fairmont at its regular meeting held on October 24, 2023, introduced and publicly read, by the entirety or by synopsis, for the first time and set for public hearing a proposed ordinance as follows:

AN ORDINANCE OF THE COUNCIL FOR THE CITY OF FAIRMONT AUTHORIZING THE ACQUISITION OF CERTAIN REAL ESTATE PURSUANT TO THE PROVISIONS OF CHAPTER 54 OF THE WEST VIRGINIA CODE FOR USE IN THE OPERATION OF THE CITY’S SANITARY SEWER UTILITY , WHICH REAL ESTATE IS DESCRIBED AS FOLLOWS:

FAIRMONT CITY DISTRICT, MAP / PARCEL 36 / 0225; AND

LS 6-7 BLK A BUFFALO ST,
JACKSON ADD,
FAIRMONT CITY DISTRICT, MAP / PARCEL 36 / 0224

AND BEING THE SAME REAL ESTATE ACQUIRED BY ALBERT B. EDDY, JR., BY DEEDS FROM G. RUSSELL ROLLYSON, JR., DEPUTY COMMISSIONER OF DELINQUENT AND NONENTERED LANDS OF MARION COUNTY, WEST VIRGINIA, WHICH DEEDS ARE DATED JUNE 15, 2022, AND OF RECORD IN THE OFFICE OF THE CLERK OF THE COUNTY COMMISSION OF MARION COUNTY, WEST VIRGINIA, IN DEED BOOK 1304, AT PAGES 580 AND 559, RESPECTIVELY, AND AUTHORIZING AND EMPOWERING THE CITY MANAGER TO DO ALL THINGS REASONABLE AND NECESSARY IN CONNECTION THEREWITH.

This ordinance approves the acquisition of certain real estate pursuant to the provisions of Chapter 54 of the West Virginia Code from Albert B. Eddy, Jr., in furtherance of the continued operation of City’s Sanitary Sewer Utility, and which real estate is identified in the ordinance title.

This ordinance provides that the cost of acquisition/market value of the real estate/just compensation has been determined by a certified general real estate appraiser to be $10,600.00.

No revenue bonds or other financing is involved. The cost of acquisition will be a sanitary board revenue expense.

The Public Hearing on the proposed Ordinance will be held on Tuesday, November 14, 2023 at 7: 00 p.m., or as soon thereafter as the matter may be heard, in Council Chambers, at the City of Fairmont Public Safety Building, 500 Quincy Street, Fairmont, Marion County, West Virginia.

At which time and place all parties and interests may appear before Council and may be heard as to whether or not said ordinance shall be put into effect. At such hearing all objections and suggestions shall be heard and following said hearing Council shall take such action as it shall deem proper in the premises.

A copy of the proposed Ordinance is on file for review by interested persons during regular business hours (M-F 8:30 a.m. to 4:30 p.m.) in the office of the City Clerk, Room 312, 200 Jackson Street, Fairmont, West Virginia.

The object of the above entitled action is to recover possession of the property located at 652 Ritter Drive, Beaver, Raleigh County, WV 25827 in that the above-named respondent is wrongfull occupying such property as tenant.

And it appearing by an affidavit filed in this action that it appearing by an Affidavit of Unknown Residency filed in this action that due diligence has been used to ascertain the address or whereabouts of Matt Hammons and all efforts have been in vain. Therefore it is ordered that Matt Hammons do serve upon Tomi Peck, magistrate, whose address is 222 Main Street, First Floor, Beckley, WV 25801, an answer or other defense to the complaint filed in this action on or before a hearing November 27, 2023 at 6:00 pm, otherwise judgment by default will be taken against Matt Hammons at any time thereafter. A copy of said complaint can be obtained from the undersigned Clerk at her office.
