TO: General Lee Blankenship, or the Unknown Heirs , Devisees, Successors, and Assigns thereof

There is now pending in the Circuit Court of Wyoming County, West Virginia, the above styled Civil Action in which Big Huff Timberlands LLC, a Delaware limited liability company, authorized to do business in the State of West Virginia and whose mailing address is 3574 Teays Valley Road, Suite B, Hurricane, West Virginia, 25526, is the Plaintiff and General Lee Blankenship, or the unknown heirs, devisees, successors, and assigns thereof, are Defendants to be served by publication.

The object of the Civil Action is to obtain an Order from the Court partitioning by allotment to Big Huff the interests of all Defendants or, in the alternative, a partition by sale, of the surface estate to certain real property situate in the Oceana District of Wyoming County, West Virginia, identified more particularly as Tax Map 133, Parcel 3, containing 82.45 acres, more or less (the “Subject Property”). Defendant General Lee Blankenship died on or about September 7, 2009, as evidenced by the Certificate of Death recorded in the Office of the Clerk of the County Commission of Wyoming County, West Virginia, in Book 13, page 533. There has been no administration of the estate of General Lee Blankenship since his date of death.

Big Huff has made diligent efforts to identify the heirs, devisees, successors, and assigns of General Lee Blankenship, which efforts include, but are not limited to:

a. Reviewing all available and relevant public records located in the offices of the Clerk of the County Commission of Wyoming County, West Virginia, the Assessor of Wyoming County, West Virginia, the Clerk of the Circuit Court of Wyoming County, West Virginia, and the Tax Office of the Sheriff of Wyoming County, West Virginia;

b. Researching genealogy information, obtaining relevant public records located inside and outside of Wyoming County, West Virginia, including surrounding West Virginia counties and counties in other States, and researching current contact information through internet research and otherwise for Defendant General Lee Blankenship, or the unknown heirs, devisees, successors, and assigns thereof; and

c. Making inquiry of other owners of the Subject Property to identify the whereabouts of Defendant General Lee Blankenship, or the unknown heirs, devisees, successors, and assigns thereof.

It is therefore ORDERED that GENERAL LEE BLANKENSHlP, OR THE UNKNOWN HEIRS, DEVlSEES, SUCCESSORS, AND ASSIGNS THEREOF appear and serve upon Charles B. Dollison, counsel for Big Huff, whose address is 600 Quarrier Street, Charleston, West Virginia 25301 , a response or other defense to the Verified Petition and Complaint heretofore filed in this action thirty (30) days after the date of the first publication of notice. A copy of said Verified Petition and Complaint can be obtained from the Office of the Clerk of the County Commission of Wyoming County, West Virginia, Wyoming County Courthouse, 100 Main and Bank Streets, Pineville, West Virginia 24874.
