TRUSTEE’S SALE OF 227 BAILEY RD, CEDAR BLUFF, VA 24609. In execution of a certain Deed of Trust dated December 15, 2022, in the original principal amount of $175,757.00 recorded in the Clerk’s Office, Circuit Court for Tazewell County, Virginia as Instrument No. 220003727. The undersigned Substitute Trustee will offer for sale at public auction in the front of the Circuit Court building for Tazewell County, 101 Main Street, Courthouse Building, Tazewell, Virginia or any such temporary alternative Circuit Court location designated by the Judges of the Circuit Court on December 11, 2023, at 1:00 PM, the property described in said Deed of Trust, located at the above address, and more particularly described as follows: ALL THOSE CERTAIN LOTS OR PARCELS OF LAND TOGETHER WITH ALL APPURTENANCES THEREUPON AND EASEMENTS BENEFITING THE SAME, LYING AND BEING IN BAPTIST VALLEY, TAZEWELL COUNTY, VIRGINIA, AND WHICH LOTS OR PARCELS ARE KNOWN AND DESIGNATED AS LOTS NUMBERED NINETY-SEVEN (97), NINETY-EIGHT (98), NINETY-NINE (99), ONE HUNDRED (100), ONE HUNDRED ONE (101), ONE HUNDRED TWO (102), ONE HUNDRED THREE (103) AND ONE HUNDRED FOUR (104), AS SHOWN AND DESIGNATED UPON A MAP WITH CERTIFICATE BY JOHN W. WHITT, JR. DATED APRIL 23, 1946, AND BEING OF RECORD IN THE CLERK`S OFFICE OF TAZEWELL COUNTY, VIRGINIA, IN DEED BOOK 167, PAGE 572, AND WHICH MAP IS ENTITLED “SUBDIVISION OF THE JOHN W. WHITT, JR. FARM, BAPTIST VALLEY, TAZEWELL CO., VA”, REFERENCE TO WHICH IS HERE MADE. “AND AS APPURTENANT TO THE LOTS HEREIN CONVEYED, THE PARTIES OF THE FRIST PART ALSO GRANT AND CONVEY UNTO THE PARTY OF THE SECOND PART, THE RIGHT TO SECURE WATER BY PIPELINE OR OTHERWISE, FROM THE SPRING LOCATED IN A 30-FOOT STREET SHOWN ON SAID MAP AND AT THE SOUTH END THEREOF, AND ANY PIPELINE FROM SAID SPRING TO THE LOTS HEREIN CONVEYED SHALL BE ALONG SAID STREET, SAID WATER RIGHT SHALL BE IN COMMON WITH THE OWNERS OF THE OTHER LOTS IN SAID SUBDIVISION, AND THE GRANTEES HEREIN, SHALL ALSO HAVE THE RIGHT TO SECURE WATER BY BUCKET FROM THE SPRING LOCATED ON LOT NO. 164, WHICH SPRING IS HERE THE LOTS HEREIN CONVEYED, TOGETHER WITH THE RIGHT OF INGRESS AND EGRESS FOR THE PURPOSE OF CARRYING WATER THEREFROM.” TERMS OF SALE: ALL CASH. A bidder’s deposit of ten percent (10%) of the sale price or ten percent (10%) of the original principal balance of the subject Deed of Trust, whichever is lower, in the form of cash or certified funds payable to the Substitute Trustee must be present at the time of the sale. The balance of the purchase price will be due within fifteen (15) days of sale, otherwise Purchaser’s deposit may be forfeited to Trustee. Time is of the essence. If the sale is set aside for any reason, the Purchaser at the sale shall be entitled to a return of the deposit paid. The Purchaser may, if provided by the terms of the Trustee’s Memorandum of Foreclosure Sale, be entitled to a $50 cancellation fee from the Substitute Trustee, but shall have no further recourse against the Mortgagor, the Mortgagee or the Mortgagee’s attorney.
