NOTICE OF SUBSTITUTE TRUSTEES’ FORECLOSURE SALE OF VALUABLE
REAL ESTATE

Upon notification by First Community Bank, the holder of a Note secured by a Deed of Trust dated August 22, 2011, executed by Eellie A. Lambert, unto Gary R. Mills as Trustees, recorded in the Office of the Clerk of the County Commission of Mercer County, West Virginia in Trust Deed Book 1216, at Page 672, of a default, and having been requested to institute these proceedings, and by virtue of the authority vested in us by a Substitution of Trustees, dated September 15, 2023, recorded in said Clerk’s Office in Resignation and Substitution of Trustee Book 1463, at Page 59, by which we were substituted as trustees for the said Gary R. Mills, we will
ON THE 28th DAY OF NOVEMBER, 2023, AT 10:00 O’CLOCK A.M., at the front door of the Mercer County Courthouse at Princeton, West Virginia, offer for sale at public auction to the highest bidder, the following property, to-wit:
“all that certain tract or parcel of land located in Beaver Pond District, Mercer County, West Virginia, and designated as Tract “A” as shown on a Plat of survey entitled, “Map Showing Div. Of Parcels 78, 79.1, 77, 75 & Part 74 TM 12 Off of State Route 20, Beaver Pond District, Mercer County, WV, Job No. 10148, Date: 10-25-10; Scale: 1” = 60’, Drawn By: JWL, Ck’d By: MAK” prepared by Appalachian Engineering & Surveying, Inc., 212 College Ave., Bluefield, WV 24701, Phone: 304-325-3481” said Map recorded in the Office of the Clerk of the County Commission of Mercer County, West Virginia as microfilm plat #166600, and “more particularly bounded and described as follows:
“BEGINNING at a point in the southern right-of-way line of St. Rte. 20, said point being the northeast corner of Parcel 71 and the northwest corner of Parcel 78 and the herein described tract; thence along said right-of-way N. 65° 09’ 50” E. 37.66 feet to a point; thence leaving said right-of way and along the western line of Parcel 79, S. 24° 11’ 37” E. 253.01 feet to a point; thence along the southern line of Parcel 79 for the next two calls: S. 84° 54’ 00” E. 92.10 feet to an iron pipe; S. 88° 11’ 38” E. 280.55 feet to a corner fence post; thence along the western line of Parcel 80.2, S. 32° . 13’ 37” E. 64.53 feet to a capped rebar; thence through Parcel 75 and 78 for the next two calls: S. 65° 56’ 10” W. 199.06 feet to a capped rebar; S. 73° 15’ 37” W. Passing a capped rebar on line at 147.16 feet and continuing for a total distance of 178.91 feet to a point; thence along the eastern line of Parcel 71, N.. 24° 31’ 44” W. 460.88 feet to the point ofBEGINN1NG and containing 1.47 acres, more or less.”
AND BEING the same property conveyed unto Ellie A. Lambert, by Willis E. Bishop and Mary Ann Bishop, husband and wife, by Deed dated November 10, 2010, of record in the Office of the Clerk of the County Commission of mercer County, West Virginia, in Deed Book 955, at Page 784.
“There is excepted and reserved a 30 feet wide right-of-way for ingress and egress to service other properties along the western line of the above described tract as shown on said Map. The Grantors, their successors and assigns, and the Grantee shall together utilized the 30 feet wide right of way for access to their respective properties.”
“This deed is expressly made subject to all restrictions, reservations, limitations, conditions and reciprocal easements set forth or referred to in the last above mentioned deed, reference to which is hereby made.”
The terms of the sale shall be cash in hand on the day of sale (or such other arrangement as may be satisfactory to said Substitute Trustees and holder of the Note), and said property is being sold in “as is” condition. Said sale is subject to all taxes now due or to become due on said property, all liens, including but not limited to, sewer liens and restrictions, easements or other matters of record in said Clerk’s Office, affecting the title to said property. The purchaser is to pay the excise tax on the privilege of transferring said real estate.
In the event there are federal tax liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale, or the period allowable for redemption under local law, whichever is longer.
Notice is also given that any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.
