NOTICE OF TRUSTEE’S SALE
NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated February 3, 2006, executed by Borrower(s), Addie Ellis, to n/a, the Trustee of record in the office of the Clerk of the County Commission of Wyoming County, West Virginia, in Book 237, at Page 473. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 30 Rolling Hills Estates, Pineville, WV 24874. WV Trustee Services, LLC were appointed as Trustee under by court order filed August 15, 2023. The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Wyoming County, in Pineville, West Virginia, on the following date:
15th day of November, 2023 at 12:00 p.m.
The surface only of that certain lot, parcel or tract of real estate, situate in Center District, Wyoming County, West Virginia, and being more particularly described as follows Lot No. Thirty (30) of the Byrd Mountain Estates Subdivision located on Byrd Branch of Bearhole Fork of Rockcastle Creek of Wyandotte, Center District, Wyoming County, West Virginia, and more particularly bounded and described as follows: BEGRINNING at a 3/8 inch iron pin in the right of way line of the street serving the Byrd Mountain Estates Subdivision, said point being the southwest corner of Lot 30 and the southeast corner of Lot 29; thence with the common boundary line of Lots 29 and 30, N. 4 degrees 31` 29` W. 167.28 feet to Station 101, the northeastern corner of Lot 29 and the northwestern corner of Lot 30; thence S. 52 degrees 41` 48” E. 187.67 feet to Station 100, a 3/8, inch iron pin; thence S. 19 degrees 15` 15” W. 100.72 feet to Station 16 a 3/8 inch iron pipe on the street right of way line; thence with said street right of way line, N. 71 degrees 00` 00” W. 91.97 feet to the beginning, containing 0.346 acres, more or less, as surveyed in December, 1993, and being all of Lot 30 of the Byrd Mountain Estates as shown on a map entitled `REVISED PLAT Of SURVEY OF BYRD MOUNTAIN ESTATES` dated 12/20/95, and recorded in the Office of the Clerk of the County Commission of Wyoming County, West Virginia in Map File No. 2888. Being the same property conveyed to Robert Ellis, now deceased, and Addie Ellis, as joint tenants with the right of survivorship, by a deed from M & B Land Sales, Inc., dated the 26th day of September, 2001 and recorded in the Office of the Clerk of the County Commission of Wyoming County, West Virginia in Deed Book 408, at page 334.
TERMS OF SALE:
1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.
2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code § 11-22-1.
3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.
4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.
5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.
6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
