NOTICE
Notice is hereby given that Marfork Coal Company, LLC, P.O. Box 457, 370 Packsville/Marfork Road, Whitesville, WV 25209 has submitted an application to the Department of Environmental Protection (DEP) 1159 Nick Rahall Greenway, Fayetteville, WV 25840 for a significant permit revision to Article 3 permit U300104 in order to Punchout the Eagle seam Deep Mine with a gravity discharge.
The revised permit will discharge into: UNNAMED TRIBUTARIES OF/AND HORSE CREEK OF MARSH FORK; CLAYS BRANCH AND STURGEON FORK OF/AND DRY CREEK OF MARSH FORK; WORKMAN CREEK AND RIGHT FORK OF/AND SYCAMORE CREEK OF CLEAR FORK, ALL OF BIG COAL RIVER OF COAL RIVER OF KANAWHA RIVER, and is located 1.9 miles southeast of Dorothy in Marsh Fork and Clear Fork Districts of Raleigh County, West Virginia, Longitude 81°-26’-11” and Latitude 37°-54’-00” (Coordinates from USS Topographic Map).
Surface of the area associated herewith is owned by: Rowland Land Company, LLC, 405 Capitol Street, Suite 609, Charleston, WV 25301, and the mineral associated herewith is owned by: Rowland Land Company, LLC, 405 Capitol Street, Suite 609, Charleston, WV 25301. Surface of the area within 100 feet of the permit is owned by: Rowland Land Company, LLC, 405 Capitol Street, Suite 609, Charleston, WV 25301, and mineral within 100 feet of the permit area is owned by: Rowland Land Company, LLC, 405 Capitol Street, Suite 609, Charleston, WV 25301.
Written Comments and/or requests for an informal conference of the surface mining application shall identify the applicant and application number and will be received by the Permit Supervisor at the DEP address above until December 25, 2023 or thirty (30) days from date of final publication. A copy of the application will be available in the DEP Regional office located at the address above until December 25, 2023, or thirty (30) days from date of final publication, and is available at:
