NOTICE OF TRUSTEE’S SALE

NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated February 22, 2005, executed by Borrower(s), James Wood and Patricia A. Wood , to Jonathan Nicol, the Trustee of record in the office of the Clerk of the County Commission of Raleigh County, West Virginia, in Book 5016, at Page 8985. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 2229 Odd Rd, Ghent, WV 25843. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated December 21, 2022, of record in the Clerk’s Office in Book 5079, Page 1834. The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Raleigh County, in Beckley, West Virginia, on the following date:

8th day of December, 2023 at 12:00 p.m.

TRACT NO. 1: That certain parcel of land situate in Slab Fork District, Raleigh County, West Virginia, and being more particularly described as follows: BEGINNING at a 12” maple, (double ivy gone), on the northeast bank of Tommy`s Creek, a common corner to a 3± acre tract, a 5.25+ acre tract and a portion of Lot 121, Finks Little Farms, conveyed to Billy Birchfield and Rebecca Birchfield, his wife, by deed dated December 3, 1948; thence leaving Lot 121 and with the common line of the 3± acre tract and the 5.25+ acre tract, S. 17 degrees 21` W. 302.7 feet to a point; thence leaving the 3+ acre tract and through the 5.25+ acre tract by a new line hereby establishing, N. 72 degrees 39` W. 291.0 feet to a stake lying in the common boundary line between the 5.25+ acre tract and 1.73± acre tract; thence with the common boundary line, N. 2 degrees 43` W. 314.0 feet to Tommy`s Creek, on the line of Lot 121, Finks Little Farms, leaving the 1.73+ acre tract at 186.7 feet; thence with Lot 121 and the meanderings of Tommy`s Creek 470+ feet to the beginning, leaving the residue of Lot 121 at 420+ feet containing 2.60 acres more or less, and shown colored yellow on a map titled, “Map Showing 2.60 Acre Tract, Slab Fork District, Raleigh County, West Virginia, prepared by Engineering Department of Thomas W. Howard, Inc., dated December 1, 1969.” Being the same property conveyed to James E. Wood and Patricia Ann Wood, husband and wife, by a deed from Bonnie Walker, window, et als, dated the 1st day of December, 1969 and recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia in Deed Book 485, at page 193. TRACT NO. 2: That certain parcel of land situate in Slab Fork District, Raleigh County, West Virginia, more particularly described as follows: BEGINNING at a double ivy on the north bank of Tommy`s Creek; thence S. 17 degrees 21` W. and with the Moore line 700 feet to a stake in a line of Vencill; thence leaving the Moore line N. 81 degrees 00` E. 394.1 feet; thence N. 16 degrees 40` W. 638.8 feet to the beginning, containing three acres, more or less. Being the same property conveyed to James E. Wood and Patricia Ann Wood, husband and wife, by a deed from Bonnie Walker, widow, et als, dated the 1st day of December, 1969 and recorded in the aforesaid Clerk`s Office in Deed Book 486, at page 415.

Being the same property conveyed to James Wood and Patricia A. Wood by the Deed dated February 2, 2017 and recorded in Deed Book 5064 at Page 5449 in the Office of the Clerk of the County Commission of Raleigh County, West Virginia.

TERMS OF SALE:

1) The property will be conveyed in an “AS IS” physical condition by Deed
containing no warranty, express or implied, subject to the Internal
Revenue Service right of redemption, all property taxes, prior Deeds,
liens, reservations, encumbrances, restrictions, rights-of-ways,
easements, covenants, conveyances and conditions of record in the
Clerk’s office or affecting the subject property.

2) The Purchaser shall be responsible for the payment of the transfer
taxes imposed by the West Virginia Code § 11-22-1.

3) The Beneficiary and/or the Servicer of the Deed of Trust and Note
reserve the right to submit a bid for the property at sale.

4) The Trustee reserves the right to continue sale of the subject property
from time to time by written or oral proclamation, which continuance
shall be in the sole discretion of the Trustee.

5) The Trustee shall be under no duty to cause any existing tenant or
person occupying the property to vacate said property, and any
personal property and/or belongings remaining at the property after
the foreclosure sale will be deemed to constitute ABANDONED
PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

6) The total purchase price is payable to the Trustee within thirty (30)
days of the date of sale, with ten (10%) of the total purchase price
payable to the Trustee at sale.
