OF PETITION FOR FORFEITURE
The object of this suit is to seek an Order forfeiting the herein described property pursuant to the West Virginia Contraband Forfeiture Act (Chapter 60A, Article 7, of the West Virginia Code, as amended).
TO ANY CLAIMANT OF A RIGHT OR INTEREST IN SAID PROPERTY
You have the right to file a claim to the herein described property on or before the 13th day of December, 2023. Any such claim must clearly state the identity of the Claimant and an address where legal process can be served upon said Claimant. The property seized and subject of this suit is described as follows SEVEN THOUSAND FIVE HUNDRED SIXTY-FOUR DOLLARS ($7,564.00) IN UNITED STATES CURRENCY, TAURUS G2C 9MM PISTOL, S/N ADL936122 AND A JENNINGS J-22 .22LR PISTOL, S/N 3633.
The Law Enforcement Agency responsible for this action is THE MARION COUNTY SHERIFF’S DEPARTMENT. The seizure took place on October 25, 2023, in Marion County, West Virginia.
That a certain SEVEN THOUSAND FIVE HUNDRED SIXTY-FOUR DOLLARS ($7,564.00) IN UNITED STATES CURRENCY, A TAURUS G2C 9MM PISTOL S/N ADL936122 AND A JENNINGS J-22 .22LR PISTOL, S/N 3633, was in the possession of James Potter and Amanda Potter, found during a search of their person and truck on October 25, 2023, during suspicious activity that occurred at Goodwill, 50 Southland Drive, Fairmont, West Virginia.
That after the date for filing of said claims an Order of the Court directing forfeiture of said seized property to the State and vesting ownership of said property shall be sought.
If you fail to file a claim, thereafter an Order, upon proper hearing may be entered against you for the relief demanded in the petition.
A copy of said petition may be obtained from the Circuit Clerk of the Court.
