NOTICE OF TRUSTEE’S SALE

Under authority of that certain Deed of Trust dated May 21, 2021 from Robert Scott Wilson and Maggie Rose Curry to Marc B. Lazenby, Trustee, of record in the office of the Clerk of the County Commission of Marion County, West Virginia in Trust Deed Book No. 1275, at page 928, securing a promissory note in the principal amount of $80,140.72, payable to Vanderbilt Mortgage and Finance, Inc., and default having been made under the promissory note secured by the aforesaid Deed of Trust and sale requested by Vanderbilt Mortgage and Finance, Inc., the undersigned Trustee will offer for sale at the front door of the Marion County Courthouse in Fairmont, West Virginia, on January 12, 2024 at 12:00 p.m., subject to all reservations, exceptions, easements and other matters which appear of record, and subject to all unpaid taxes, if any, that certain piece or parcel of land, together with the improvements thereon and appurtenances thereunto belonging, situate on the waters of Goose Creek of Tygart Valley River, in Union District, Marion County, West Virginia, more particularly described as follows:

Beginning at a No. 4 rebar found on the southeasterly line of Levels Road or Marion County Route 31/4 and twenty feet southeast of the center line thereof, said point further being the common northwesterly corner of Parcel “C” as owned by Gary W. Sr. and Mary C. McDaniel in Deed Book 925, Page 377 and Parcel “D” in the Division of the J.H. Arnett Tract, thence S 46-16-04E 170.13 feet, leaving the said road and running with the common line of the said Parcels “C” and “D” to a No. 5 rebar with cap set, from which a roof bolt found on said line is located S46-16-04E 113.57 feet; thence S58-58-51W, leaving the said Parcel “C” and running through the said Parcel “D”, passing a point on a sewer outflow line in a ten foot wide right-of-way at 35.56 feet, in all 196.87 feet to a No. 5 rebar with cap set on the northerly bank of a small drain; thence N49-29-49W 165.16 feet, continuing through the said Parcel “D” to a point in a drain on the southeasterly line of the aforementioned Levels Road or Marion County Route 31/4, from which a cross cut on the influent end of a concrete drain bears N49-29-49W 6.12 feet and a No. 5 rebar found bears S56-52-52W 51.86 feet; thence N56-52-52E 204.61 feet, running with the said road to the point of beginning, containing in all 0.743 acre, more or less, all as shown more fully upon a map or plat thereof entitled “PLAT SHOWING PART OF PARCEL “D”, DIVISION OF THE J.H. ARNETT TRACT ON THE WATERS OF GOOSE CREEK OF TYGART VALLEY RIVER UNION DISTRICT, MARION COUNTY, WEST VIRGINIA TO BE CONVEYED TO SCOTT WILSON SCALE: 1” = 50’ JANUARY 6, 2021” as surveyed and mapped by William R. Gunnoe, Registered Professional Surveyor.

There is excepted and reserved from this conveyance an easement ten feet wide for the upkeep, maintenance, removal and replacement of an outflow line for a sewage aerator located on the remaining property of the Grantors herein.

Together with a certain 2021 CMH Mobile Home, Serial No. CLM109400TN.

Being the same property conveyed from James L. Wilson and Suzanne Wilson to Robert Scott Wilson and Maggie Rose Curry by Deed dated May 21, 2021, of record in the aforesaid Clerk’s office in Deed Book No. 1282, at page 449.
