Notice is herby given that MABEN COAL LLC 250 WEST MAIN STREET, SUITE 1800, LEXINGTON, KY 40507 has submitted an application to the Department of Environmental Protection (DEP), Division of Mining and Reclamation (DMR) located at 1159 Nick Rahall Greenway, Fayetteville, WV 25840 for an Article 3 permit for the surface disturbance of approximately 265.32 acres in order to highwall and contour mine in the Sewell seam of coal. The proposed operation is discharging into Unnamed tributaries of Slab Fork, and Slab Fork, of Guyandotte River, of Ohio River of OHIO RV and is located 5.3 miles, north of Mullens in Slab Fork Districts of Wyoming and Raleigh Counties, Longitude 81o21’52” Latitude 37o39’34”.

Written comments and/or requests for an informal conference of the surface mining application shall identify the applicant and application number and will be received by the Permit Supervisor at the DEP address above until 2/8/2024, or thirty (30) days from the date of final publication. A copy of the application will be available for review until 2/8/2024 or thirty (30) days from the date of the final publication in the DEP Regional Office located at the address above and is available online at:
