Separate sealed BIDS for the construction of Glen Morgan Wastewater Treatment Plant Upgrades consisting of: Upgrading the wastewater treatment plant from a design capacity of 1.2 MGD to 1.6 MGD by addition of a new 400,000 GPD treatment unit, rehabilitation of the three (3) existing treatment units, a new mechanical filter screen and compactor, new blowers and controls, new UV units, UV disinfection trough with canopy, non-potable water piping system, and other miscellaneous improvements will be received by Shady Spring Public Service District at the office of Shady Spring Public Service District until 2:00 p.m., (Local Prevailing Time) February 7, 2024 and then at said office publicly opened and read aloud. A Two Envelope bidding process will be conducted as detailed in the contract documents under “Instructions to Bidders”.

Prospective bidders will be required to use the CONTRACT DOCUMENTS as supplied by the Engineer. Electronic copies of the CONTRACT DOCUMENTS containing Contract can be obtained from the office of the Engineer, L.A. Gates Company, 2302 South Fayette Street, Beckley, West Virginia 25832 and at the Shady Spring Public Service District Office. A full-size paper Contract Set is also available for viewing at L.A. Gates Company and Shady Spring Public Service District Offices. A geotechnical report is also available.
All contractors must also obtain Plans, Specifications, and Bid Forms from the Engineer in order to bid.
A five percent (5%) Bid Bond or certified cashier’s check must accompany all Bids.
Prospective Bidders are advised that the contract awarded under this Advertisement for Bids is to be funded by a loan through the Clean Water State Revolving Fund Program (CWSRF). Neither United States nor any of its departments, agencies, or employees is or will be a party to this Advertisement for Bids or any resulting contract.
This construction of this project will be funded in part with funds made available from the Federal Government through the US Army Corps of Engineers Section 340 program. Bidders must comply with all applicable laws and regulations for construction projects receiving Federal aid including, but not limited to, the Civil Rights Act of 1964, the Contract Work Hours and Safety Standards Act, and the Davis-Bacon Act as amended.
“Nondiscrimination in Employment” – Bidders on this work will be required to comply with the President’s Executive Order No. 11246, which prohibits discrimination in employment regarding race, creed, color, sex, or national origin. The requirements for bidders and contractors under this order are explained in the specifications.
Bidders must comply with Title VI of the Civil Rights Act of 1964, the Davis-Bacon Act, the Anti-Kickback Act and the Contract Work Hours Standards Act.
All Bidders are required to have a West Virginia Contractor’s License per Section 521-11-11 of the West Virginia Code.
Recipient shall not entertain the use of businesses that are listed on the “Excluded Parties List System” at www.eplus.gov in accordance with 2 CFR Part 1532 and Subpart B and C of 2 CFR Part 180.
Per the requirements of the Article 21-11-11 of the Code of the State of West Virginia, any Contractor submitting a Bid on this project hereby certifies, indicates, and acknowledges that he/she has a Contractor’s license from the State of West Virginia and meets all the qualifications required by the statutes of the state and location in which the Work is to be performed.
Successful bidders shall be required to comply with all laws pertaining to the federal wages issued in accordance rate for a worker classification, the Contractor will be required to l) identify the applicable Federal wage rate for the worker classification, and 2) select and pay the highest of the wage rates for the worker classification. Wage Rate Decisions are included in the Contract Documents and will be updated as required by addendum prior to the bid opening date.
Per the requirements of the Article 21-1 D-5 of the Code of the State of West Virginia, any Contractor submitting a bid for a public improvement construction contract shall provide an affidavit of compliance that the Contractor has a written plan for a drug-free workplace policy. Failure to complete the Drug Free Workplace Conformance Affidavit Bid Form shall result in disqualification of the Bid.
Per the requirements of Public Law (P.L.) 113-76, Consolidated Appropriations Act, 2014, any Contractor submitting a bid for this project shall provide a signed American Iron and Steel Certification (AIS) acknowledging that they have read, understand, and will comply with the AIS requirements. Failure to submit the Certification shall result in disqualification of the Bid.

CFR Part 1532 and Subpart B and C of 2 CFR Part 180.”
DBE REQUIREMENTS
Each Bidder must fully Comply with the Disadvantaged Business Enterprises, and Affirmative Action Requirements, as identified in the contract documents.
The Bidder agrees to make “positive efforts” to subcontract a portion of the total value of the contract to Disadvantaged Business Enterprises. This shall be done in compliance with the six (6) affirmative steps as outlined in 40 CGR 33.240. Failure to demonstrate positive efforts to do so may lead to rejection of bids. For this program, the term “subcontract” includes all construction, modification, and service work contracted for by the bidder in the execution of the work under this contract.
Compliance with all other applicable federal and state regulations is required.
All prospective Bidders are required to attend a Pre-Bid Conference to be held at the Office of Shady Spring Public Service District on January 10, 2024 at 2:00 p.m. for the purpose of discussing the project and touring the project site.
