The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated November 22, 2019, and duly recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Deed of Trust Book 5070, at Page 8395, Amanda Harless did convey unto Brian Carr, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Raleigh County Courthouse, in Beckley, West Virginia, on

January 10, 2024, at 9:56 AM

The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Town District, Raleigh County, West Virginia, and more particularly described as follows:

The surface of Lot No. 3 as shown on a “Plat of Subdivision of 1.485-Acre Tract at Oak Grove, Near Crab Orchard, Town District, Raleigh County, West Virginia Standing in the names of Elmer L. Redden and Dora S. Redden by James E. Cook, P.S. 361 Pluto Road, Shady Spring, WV 25918 Scale: 1” = 60’ March 7, 1997, “ as shown on a map recorded in Map File 3, Page 523, said Lot 3 being more particularly described as follows:

BEGINNING at a point on the easterly right of way line of Secondary Route 18 and being a corner of Lots 2 and 3 of said subdivision; thence with the common line of Lots 2 and 3 N. 67° 16’ E. a distance of 118.55 feet to a point in the easterly line of said subdivision; thence S. 22° 44’ E. a distance of 100.00 feet to a common corner of Lots 3 and 4; thence with the common line of Lots 3 and 4 S. 67° 16’ W. a distance of 106.02 feet to a common corner of Lots 3 and 4 on the easterly right of way line of Secondary Route 18; thence with the said easterly right of way line R = 650.00’, Arc – 100.88’, Chord = N. 29° 52’ W. 100.78 feet to the point of beginning.

There is EXCEPTED and RESERVED, a certain sewer easement ten (10) feet in width and running parallel with and one (1) foot from the easterly right of way line of Secondary Route 18 and the purpose of said sewer easement being so as to have access to the same for maintenance purposes of said sewer

At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 481 Oak Grove Road, Beckley, WV 25801.

AND BEING the same real estate which was conveyed to Amanda Harless, by Deed dated November 22, 2019, from Michael G. Richmond, Jr., and recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Deed Book 5070 at Page 8394.

The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.

The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
