TRUSTEE’S SALE OF
VALUABLE REAL ESTATE

The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated January 6, 2015, and duly recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Deed of Trust Book 5057, at Page 6180, Larry A. Clay, Jr. aka Larry Allen Clay, Jr. did convey unto Todd Taylor and Dan Kennedy, Trustees, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Raleigh County Courthouse, in Beckley, West Virginia, on

January 10, 2024, at 10:00 AM

The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Slab Fork District, Raleigh County, West Virginia, and more particularly described as follows:

Beginning at a point on the northeastern corner of said parcel 200 feet, more or less, from State Route 44 (road from Odd to Fireco) and running in a straight line more or less parallel to said road a distance of 105 feet; thence running from the southeastern corner in a straight line perpendicular to the first boundary line a distance of 105 feet; thence running from the southwestern corner in a straight line perpendicular to the preceding boundary line a distance of 05 feet; thence from the northwestern corner in a straight line perpendicular to the preceding boundary line and more or less parallel to and 40 feet, more or less, from a privately owned dirt road (a road to a strip-mining operation), said straight line running a distance of 105 feet to the place and point of beginning, being a square lot 105 feet by 105 feet, containing 0.25 acre, more or less.

At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 201 Galena Road, Odd, WV 25902.

AND BEING the same real estate which was conveyed to Larry Allen Clay, Jr., by Deed dated July 20, 2011, from Kathy Sue Clay, and recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Deed Book 5043, at Page 8382.

THIS PROPERTY IS BEING SOLD SUBJECT TO A FIRST DEED OF TRUST, DATED DECEMBER 30, 2014, SECURING CITY NATIONAL BANK OF WEST VIRGINIA, AND RECORDED IN DEED OF TRUST BOOK 5057, AT PAGE 5751.

The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.

The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

TERMS: Ten percent (10%) of the purchase price as a deposit with the balance due and payable within 30 days of the day of sale.
