NOTICE OF FILING OF
PETITION FOR FORFEITURE

The object of this suit is to seek an Order forfeiting the herein-described property pursuant to the West Virginia Contraband Forfeiture Act, (Chapter 60A, Article 7, of the West Virginia Code, as amended).
TO: Any claimant of a right or interest in said property.
You have the right to file a claim to the herein-described property on or before February 17, 2024. Any such claim must clearly state the identity of the claimant and an address where legal process can be served upon said claimant.
1. The property seized and subject of this suit is described as follows:

5097 MILLER RIDGE ROAD, HICO, FAYETTE COUNTY, WEST VIRGINIA; NEW HAVEN TAXING DISTRICT, TAX MAP 21, PARCEL 76; NEW HAVEN TAXING DISTRICT TAX MAP 21, PARCEL 99; and NEW HAVEN TAXING DISTRICT TAX MAP 21, PARCEL 99.1, REAL PROPERTY DESCRIBED IN THE LAST WILL AND TESTAMENT OF MARY ELLEN KENNEY AND DEVISED TO JAMES F. KENNEY, WITH SAID LAST WILL AND TESTAMENT BEING OF RECORD WITH THE CLERK OF THE COUNTY COMMISSION FOR FAYETTE COUNTY, WEST VIRGINIA IN WILL BOOK 98 AT PAGE 728

2. The law enforcement agency responsible for the seizure is the Central Regional Drug and Violent Crime Task Force.

3. The Respondent Property and real property subject to forfeiture is real property located at 5097 Miller Ridge Road, Hico, West Virginia.
4. The Respondent Property and real property subject to forfeiture is further real property described in deed of record with the Clerk of the County Commission, Fayette County, West Virginia in Will Book 98 at Page 728, recorded December 15, 2023.
5. Respondent, James F. Kenney, acquired an interest in and/or title to the above-described property via the aforementioned Last Will and Testament of Mary Ellen Kenney.
6. Respondent, James F. Kenney, was in possession of the Respondent Property at all times described herein.
7. After the date for filing of said claims, an Order of the Court directing forfeiture of the seized property to the State and vesting ownershiip of said property in the State shall be sought.
If you fail to file a claim, thereafter an Order, upon proper hearing, may be entered against you for the relief demanded in the Petition.
A copy of said Petition can be obtained from the undersigned Clerk at his office.

NOTICE

The McDowell County Solid Waste Authority will hold a public hearing concerning the five-year updates of the Comprehensive Litter and Solid Waste Control Plan and the Commercial Solid Waste Facility Siting Plan. The hearing will take place on Friday, February 16 in the McDowell County Solid Waste Authority board room, located underneath magistrate court in Welch, during which time public comments will be heard. The plan may be viewed at the McDowell County Library, Welch, WV, the McDowell County Clerk’s Office, and Region I Planning and Development Council, 1439 E. Main Street, Suite 5, Princeton, WV. Written comments will be accepted until February 28, 2024 and can be mailed to the McDowell County Solid Waste Authority, P.O. Box 858, Welch, WV 24801 or [email protected].
