LEGAL NOTICE
REQUEST FOR PROPOSALS FOR LEGAL SERVICES

The Wyoming County Economic Development Authority (Wyoming EDA), West Virginia is in the process of procuring for a project attorney to complete the necessary legal services for the Huff Creek Broadband Fiber Deployment ARC POWER Initiative Project. The selected project attorney will work closely with the Wyoming EDA, Region I Planning & Development Council, and Thompson & Litton Engineering.

The project attorney is an integral part of the project team and will provide general legal services as necessary during the development and construction of the project. Areas of practice include but are not limited to necessary title work to obtain construction rights-of-way and parcels, and review of all contracts and related documents.

Procurement of the said services shall be in accordance with 2 CFR 200.320(b)(2). The contract will be awarded to the responsible offeror whose proposal is within the competitive range and determined to be the most advantageous to the project, price and other factors considered including familiarity and expertise with this type of project. The Consultant’s eligibility to receive federal funds will be verified at http://www.sam.gov prior to contract award. The contract will be based on a not-to-exceed amount.

All those interested in being considered must submit a proposal detailing qualifications and staffing capabilities, related prior work experience, fee schedule and ability to complete work as needed on this project in a timely manner.

Interested firms must submit one (1) original, three (3) copies, and one (1) digital format submission of all requested information to Wyoming County EDA, and one (1) copy, and one (1) digital format submission to Region I Planning & Development Council at their addresses below:

The deadline for receipt of proposals is 4:00 p.m. on February 16, 2024. It is the responsibility of the respondent to ensure the receipt of the proposal by the date and time specified. Please direct any questions to Jason Roberts at [email protected].

Attention is directed to the fact that the proposed project will be undertaken through funding sources including, but not limited to an ARC POWER Initiative Grant and local funds. All work will be performed in accordance with the regulations issued by the funding agency and the State of West Virginia appertaining thereto.

The Wyoming County EDA will afford full opportunity for minority business enterprises to submit a show of interest in response to this invitation and will not discriminate against any interested firm or individual on the grounds of race, color, creed, sex, age, handicap or national origin in the contract award.

The Wyoming County EDA reserves the right to accept or reject any and/or all proposals. The Wyoming County EDA also reserves the right to negotiate the fee for services.
