NOTICE OF TRUSTEE’S SALE

NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated May 23, 2022, executed by Borrower(s), Michael A Williams, to Richard A. Pill, the Trustee of record in the office of the Clerk of the County Commission of Raleigh County, West Virginia, in Book 5076, at Page 4239. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 275 Coal River Rd, Glen Daniel, WV 25844. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated November 30, 2023, of record in the Clerk’s Office in Book 5081, Page 8684. The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Raleigh County, in Beckley, West Virginia, on the following date:

A certain lot or parcel of land situated in Trap Hill District, Raleigh County, West Virginia, and more particularly bounded and described as follows: ALL THAT CERTAIN TRACTS OR PARCELS OF LAND SITUATE IN TRAP HILL TAX DISTRICT, RALEIGH COUNTY, WEST VIRGINIA, AND BEING MORE PARTICULARLY BOUNDED AND DESCRBED AS FOLLOWS, TO- WIT: FIRST TRACT: BEGINNING at a fence post in the north right of way line of State Road No. 3, N 62° 30` W 550.3 feet to a fence post; N 32° 05` E 194,4 feet to a fence post, S 74° 05` E 520.4 feet to a fence post in said right of way line; thence with same S 25° 35 W 220.3 feet; S 14 30` W 80.6 feet to the BEGINNING, containing 2.96 acres; and which said tract or parcel of land is shown and designated upon the Raleigh County Assessors Tax Map for Trap Hill Tax District numbered 14, as Parcel No. 22. SECOND TRACT: BEGINNING at a fence post in the west right of way line of State Road No. 3, a corner to land conveyed to Charles Sawyers by Myrle Jarrell, by Deed dated June 21, 1938, and of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Deed Book No. 149, at page 352; thence with a line of said tract N 74° 05` W 87.4 feet to a fence post; thence leaving said line N 86° 30` E 98 feet to a fence post in right of way line of above-mentioned lot; thence with said right of way line S 25° 35` W 33 feet to the BEGINNING, containing .033 of an acre; and which said tract or parcel of land is shown and designated upon the Raleigh County Assessor`s Tax Map for Trap Hill Tax District numbered 14, as Parcel No. 21. THERE IS EXCEPTED AND RESERVED FROM THE OPERATION OF THIS DEED the following described out conveyances from the above described real estate, to-wit: 1. That certain conveyance made by Edna Wills, single, to Wendell Wills and Virginia Jo Wills, his wife, by Deed dated May 17, 1978, and of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Deed Book No. 597, at page 24. 2. That certain conveyance made by Edna Wills, single, to Wendell Wills and Virginia Jo Wills, his wife, by Deed of easement for right of way dated May 28, 1979, and of record in the office of the clerk of the county commission of Raleigh County, West Virginia, in Deed Book No. 613, at Page 662. 3. That certain conveyance made by Edna Wills, single, to Wendell Wills and Virginia Jo. Wills, his wife, by deed dated May 3, 1985, and of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Deed Book No. 696, at Page 513. A metes and bounds description of the combined parcels is as follows: Beginning at a point on the Northern right of way of W. VA. Route 3; Thence N 62° 30` W 550.3 feet to a fence post; N 32° 05` E 194.4 feet to a fence post; Thence S 74° 05` E 433 feet to a point; Thence N 86° 30` E 98 feet to a fence post on the said W. VA. Route 3 right of way; Thence with the right of way S 25° 35` W 253.3 feet to a point; Thence with the right of way S 14° 30` W 80.6 feet to the point of beginning. The combined parcels description, excepting and reserving the said out conveyances, totals 1.603 acres, more or less. Being the same property conveyed unto Michael A. Williams, by Deed of William Henry Newton and Kathie Ann Newton, dated May 23, 2002 and recorded in the Office of the Clerk of the Raleigh County Commission simultaneously with this Deed of Trust.

Being the same property conveyed to Michael A Williams by the Deed dated May 23, 2022 and recorded in Deed Book 5076 at Page 4238 in the Office of the Clerk of the County Commission of Raleigh County, West Virginia.

TERMS OF SALE:

1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.

2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code § 11-22-1.

3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.

4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.

5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
